Dear Mr. Curley,

I am responding to your letter of July 14,1997 to Mr. Richard Conte, Chief, Reactor Projects Branch No. 8, of this office requesting an NRC speaker to discu.ss the decommissioning rule (10CFR 50.82) at the next regularly scheduled meeting of the CDAC on July 29,1997 in Middletown, CT. This letter is also to document a telephone conversation on July 14,1997, between Mr. Ken Hampton, Chairman, CDAC, and Mr. Conte concerning ongoing support for the CDAC from NRC and concerning selected technical issues on the Haddam Neck facility and related decommissioning activities.

For the meeting of July 29,1997, Mr. Michael Masnik from the Office of Nuclear Reactor Regulation, will present an overview of the new decommissioning rule to the panel, as requested in your July 14 letter. Mr. Masnik was a contributing author of the rule and has extensive experience in the area of decommissioning as a project manager. He will be accompanied by Region I representatives Messrs R. Conte and W. Raymond, Senior Resident inspector (SRI), Haddam Neck.

Mr. Hampton and other CDAC panel members have informally requested NRC staff presence, namely, the Senior Resident inspector, at your monthly meetings. Mr. Hampton indicated that NRC presence could address activities and alleviate concerns immediately or commit to review and respond at a later time, ideally, we would accommedate such a request, however, our resources, including the SRI, are very limited. Not withstanding, we will be glad to respond to your written concerns and be available to provida information on a case-by-case basis at key points in the decommissioning process, in implementing 10CFR 50.82, we plan to notice and hold a public meeting to obtain oublic comments on the licensee's Post Shutdown Decommissioning Activity Report (PSDAR) which will be available in the Public Document Rooms. We will welcome CDAC member participation, comments, and questions at that meeting.

Also in reference to the telephone conversation, Mr. Hampton agreed that future CDAC panel member questions and concerns would be formalized and channeled through the committee and addressed to the NRC staff in writing. These questions / concerns should be forwarded to Mr. Conte at the NRC Region I office in King of Prussia, PA. All responses will be made available in the Public Document Rooms.
