Dear Mr. Scarpello:

By letter dated April 7, 2020 (Agencywide Documents Access and Management System Accession No. ML20126G456), Indiana Michigan Power Company (I&M, the licensee) submitted license amendment requests for the Donald C. Cook Nuclear Plant, Unit Nos. 1 and 2 (CNP), to revise TS 5.5.12, "Technical Specifications (TS) Bases Control Program", within each Unit's TS, to coincide with the CNP Updated Final Safety Analysis Report (UFSAR) update frequency. In addition, in accordance with Title 10 of the Code of Federal Regulations (10 CFR)

Section 50.12 and 10 CFR 54.15, l&M requests permanent schedular exemptions from portions of the following regulations:

1. 10 CFR 54.37, Additional records arid recordkeeping requirements, paragraph (b), which requires, in part that, certain "newly identified" items be included with "the UFSAR update required by 10 CFR 50.71(e)."
2. 10 CFR.50.54, Conditions of licenses, paragraph (a)(3), which requires, in part that, "Changes to the quality assurance program description that do not reduce commitments must be submitted to the NRC in accordance with the requirements of Sec. 50. 71(e)."

The purpose of this e-mail is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of the amendment and exemption requests. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with 10 CR 50.90, an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendments and exemptions in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

Based on the information provided in your submittal, the NRC staff has estimated the following for each amendment and exemption:

Exemption - Exemption to UFSAR 10 CFR 50.71(e)(4) Update Schedule Related to 10 CFR 50.54(a)(3) - Age Management EPID: L-2020-LLE-0053 Hours to Complete: 40 hours4.62963e-4 days <br />0.0111 hours <br />6.613757e-5 weeks <br />1.522e-5 months <br /> Target Completion Date: January 2021 If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.

These estimates are based on the NRC staffs initial review of the application and they could change, due to several factors including requests for additional information, and unanticipated addition of scope to the review. Additional delay may occur if the submittal is provided to the NRC in advance or in parallel with industry program initiatives or pilot applications.
