Enclosed please find a letter from Transnuclear, Inc. requesting wendments to export licenses XShM02241 and XSNM02315 to 1) delete NUKEM GmbH, Hanau FRG as intenrediate consignee; 2) remove Transnuklear GmbH, D-6450 Hanau II FRG as other party to the exports; and 3) add Transnucleaire, SA,11 rue Christophe Colomb, 75008 Paris, France as transporter in France.

Before taking action on this request, we would appreciate your views, in accordance with established procedures as to whether the proposed amendments meet the applicable criteria in the Atomic Energy Act, as amended by the Nuclear Nonproliferation Act of 1978.

Dear Mr. Shea:

Mba O Transnuclear Inc. is licensee for export licenses XSNM 02241 and XSNM 02315.

Material was planned to be shipped under these licenses in early 1988 in accordance with 10 CFR 73 strategic special nuclear material requirements.

The shipment was to be imported into Germany and transported within Germany by Transnuklear GmbH.

The material under licenses XSNM 02241 and 02315 was to be further transported to France.

In view of the temporary suspension of Transnuklear's and Nukem's licenses, Transnuclear has been requested by Institute Max Von Laue-Paul Langevin (ILL) in France to ship the French taaterial directly to France via.the French Air Force.

Enclosed is a copy of a letter from ILL requesting changes to licenses in question.

The inland US over the road transport for this shipment is contemplated using the services of the US DOE Safe Secure Transport System.

The US DOE, in late December stated that they would utili:e their SST System for only one more transport after which a conmercial carrier must be utilized.

At present there is no commercial carrier approved for this type of transport.

Accordingly, Transnuclear requests that the following changes be made to licenses XSNM 02241 and XSNM 02315.

Intermediate Consignee to be changed as follows:

Remove Transnuklear GmbH D-6450 Hanau II FRG And Add:

Transnucleaire, SA-11 rue Christophe Colomb 75008 Paris France (Transport purposes only) 3)

Uranium to be in the form of U metal instead of uranium hexafluoride for both licenses.

4)

Overseas transport to be performed by the French Air Force.

Tentative plans call for the shipment to take place as soon as possible.

(Exact dates cannot be transmitted in non-classified documents.)

Paul LANGEVIN (ILL) in 1.

The Institut Max Von LAUE GRENOBLE/ PRANCE has the unlimited right of use and j

consumption for the material under subject.

2.

All the material will be used in total for the fabri-cation of fuel destined for the RHP-reactor operated by ILL in GRENOBLE.

3.

All the material will be sent to CERCA/ ROMANS in FRANCE where the fabrication of the fuel elements will be exe-cuted.

4 It is not foreseen that such material will be transformed outside France and in particular it will not be shipped to persons not having all necessary a u t h o r i s a t i onti.

ILL herewith requests TRANSNUCLEAR/NY to apply for all necessa ry amendments to the above export '!cences such as deleting NUKEM and replacing TRANSNUCLEAR/HANAU by TRANSNUCLEAIRE/ PARIS.
