SUBJECT: BYRON SPECIAL INSPECTION (REPORTS NO. 50-454/94026(DRS);

NO. 50-455/94026(DRS))

Dear Mr. Graesser

This refers to the special inspection conducted by Messrs. R. M. Bailey,

N. D. Hilton and R. C. Paul of the Regional Office between November 29 and

December 20, 1994. The inspection included a review of the activities

authorized for your Byron Nuclear Power Station facility. At the conclusion

of the inspection, the findings were discussed with those members of your

staff identified in the enclosed report.

Areas reviewed during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, and interviews with personnel. The purpose of the

inspection was to determine whether activities authorized by the license were

conducted safely and in accordance with NRC requirements.

Based on the results of this inspection, two apparent violations were

identified and are being considered for escalated enforcement action in

accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions" (Enforcement Policy),10 CFR 2, Appendix C (1994).

The

apparent violations pertain to the licensee's discovery that no licensed

senior operator was in the common dual unit control room for a period of 22

minutes with a unit in power operations. The violations involve (1) failure

to maintain a licensed senior operator in the common dual unit control room

with a unit in other than cold shutdown or refueling in accordance with 10 CFR 50.54(m)(2)(iii); and (2) failure to record the occurrence in the operations

shift logs in accordance with Technical Specification 6.8.1.

Accordingly, no

Notice of Violation is presently being issued for these inspection findings.

In addition, please be advised that the number and characterization of the

apparent violations described in the enclosed inspection report may change as

a result of further NRC review.

An enforcement conference to discuss these apparent violations has been

scheduled for 2:00 p.m. (CST) on January 9,1995, at the Region III office.

The purpose of this conference is to discuss the apparent violations, their

cause and safety significance; to provide you the opportunity to point out any

errors in our inspection report; to pr6 vide an opportunity for you to present
