Please find enclosed your NRC material license. You should review this

license carefully and be sure that you understand all conditions. Your

previous license (No. 50-23418-02) has been retired since it expired on June

30, 1994. If you have any questions, you may contact the reviewer who signed

your license at 510-975-0249.

The revised 10 CFR Part 20, " Standards for Protection Against Radiation,"

became effective for all NRC licensees on January 1,1994. Licensees who are

not currently knowledgeable about the new regulations will find it difficult

to implement the regulation. If you have not implemented the revised Part 20,

you must do so immediately. You should review the enclosed NRC Information

Notices (IN) 93-03, "Recent Revisions to 10 CFR Part 20 and Change of

Implementation Date to January 1,1994," and IN 93-80, " Implementation of the

Revised 10 CFR Part 20," carefully. These Notices contain information about

revisions to Part 20, about implementing the revised regulation, and about the

availability of Regulatory Guides and other useful documents. As stated in

IN 93-80, NRC has issued eight sets of questions and answers to help you

implement and understand the revised regulations. As of January 1,1994, NRC

began to inspect and enforce the regulations in the revised Part 20 for all

licensees.

Please be advised that you must conduct your program involving radioactive

materials in accordance with the conditions of your NRC license,

representations made in your license. application, and NRC regulations. In

particular, note that you must:

1. Operate in accordance with NRC regulations 10 CFR Part 19, " Notices,

Instructions and Reports to Workers: Inspection and Investigations,"

10 CFR Part 20, " Standards for Protection Against Radiation," and other

applicable regulations.

2. Possess radioactive material only in the quantity and form indicated in

your license.

3. Use radioactive material only for the purpose (s) indicated in your

license.

4. Notify NRC in writing of any change in mailing address (no fee required l

if the location of radioactive material remains the same). i

5. Request and obtain written NRC consent before transferring your license

or any right thereunder, either voluntarily or involuntarily, directly

or indirectly, through transfer of control of your license to any person

or entity. A transfer of control of your license includes not only a

total change of ownership, but also a change in the controlling interest .

in your company whether it is a corporation, partnership, or other i

entity. In addition, appropriate license amendments must be requested

and obtained for any other planned changes in your facility or program

that are contrary to your license or contrary to representations made in

your license application, as well as supplemental correspondence

thereto, which are incorporated into your license. A license fee may be

charged for the amendments if you are not in a fee-exempt category.

6. Maintain in a single document decommission records that have been

certified for completeness and accuracy listing all the following items

applicable to the license: ,

e Onsite areas designated and formerly designated as restricted ,

areas as defined in 10 CFR 20.3(a)(14) or 20.1003.

e Onsite areas, other than restricted areas, where radioactive

materials in quantities greater that amounts listed in Appendix C ',

to 10 CFR 20.1001-20.2401 have been used, possessed, or stored.

e Onsite areas, other than restricted areas, where spills or other

unusual occurrences involving the spread of contamination in and

around the facility, equipment, or site have occurred that 4

required reporting pursuant to 10 CFR 30.50(b)(1) or (b)(4),

including areas where subsequent cleanup procedures have removed

the contamination.

  • Specific locations and radionuclide contents of previous and l

current burial areas within the site, excluding radioactive i

'

material with half-lives of 10 days or less, depleted uranium used

only for shielding or as penetrators in unused munitions, or

sealed sources authorized for use at temporary jobsites. i

e Location and description of all contaminated equipment involved in

licensed operations that is to remain onsite after license

termination.

7. Submit a complete renewal application with proper fee, or termination '

request at least 30 days before the expiration date on your license.

You will receive a reminder notice approximately 90 days before the

expiration date. Possession of radioactive material after your license ,

expires is a violation of NRC regulations. l

8. Request termination of your license if you plan to permanently

discontinue activities involving radioactive material.

10 CFR 71.12 provides for a general license to transport, or to deliver to a

carrier for transport, licensed material for which a license, certificate of

compliance, or other approval has been issued by the Nuclear Regulatory

Commission (NRC). The general license applies only if you have a quality

assurance program approved by NRC as specified in 10 CFR 71.12(b) and the

conditions specified in 10 CFR 71.12(c) and (d) are met. The attached copies

of Regulatory Guide 7.10,10 CFR Part 71, and 10 CFR Part70 may be helpful to

you. A fee for evaluation of Part 71 Quality Assurance Programs as specified

in Section 10.F in 10 CFR 170.31 must accompany your request for Quality

Assurance Program approval.

Please note that your Quality Assurance Program, associated fee, and transport

package descriptions should be submitted directly to the Director, Office of

Nuclear Material Safety and Safeguards, U.S. Nuclear Regulatory Commission,

Washington, D.C. 20555, as stated in 10 CFR 71.12(c)(3) and 10 CFR 71.101(c).

You will be periodically inspected by NRC. A fee may be charged for

inspections in accordance with 10 CFR Part 170. Failure to conduct your

program in accordance with NRC regulations, license conditions, and

representations made in your license application and supplemental

correspondence with NRC will result in enforcement action against you. This

could include issuance of a notice of violation; imposition of a civil

penalty; or an order suspending, modifying, or revoking your license as

specified in the General Policy and Procedures for NRC Enforcement Action,10

CFR Part 2, Appendix C. Since serious consequences to employees and the

public can result from failure to comply with NRC requirements, prompt and

vigorous enforcement action will be taken when dealing with licensees who do

not achieve the necessary meticulous attention to detail and the high standard

of compliance which the NRC expects of its licensees.

requested on our NRC license. The name orir;inally appearing on our license was James i

M. Montgomery Consulting Engineers (JMM). In March,1993 JMM merged with an  !

English firm whose name was Watson Hawksley. The new company became l

MONTGOMERY WATSON Americas,Inc. Neither of the old fums continued in  !

existence when the merger occurred, and all stock from both fums was converted to  !

Montgomery Watson stock.  !

Montgomery Watson honors all agreements and representations made by JMM to the hTC, i

and fully intends to abide by all conditions of the license that was originally issued to JMM.
