Areas Inspected: Special, unannounced inspection to ascertain the validity of concerns raised in two allegations received by telephone in the NRC Region I office on October 29, 1987 and November 5, 1987. The allegations concerned proper documentation of exposure to airoorne radioactive materials and receipt of radioactive material in violation of the Special Nuclear Material license i

(SNM-1067). An opening conference with licensee management and OSHA  ;

inspectors was also attended on November 17, 1987.

Results: An additional example of a violation previously cited in NRC Inspection Report No. 70-1100/87-05: failure to maintain documentation of surveys required by 10 CFR 20.201(b) and 20.205(b), as required by 10 CFR 20.401(b)(paragraph 4.0).  !

2.0 Purpose The purpose of this special, unannounced inspection was to review concerns raised as a result of two allegations received by telephone at the NRC Region I office on October 29. 1987, and November 5, 1987. The allegations concerned improper recordkeeping of airborne exposure information, and receipt of radioactive material for which the licensee had no authorization.

The inspector also attended an opening conference with licensee management, the local union president, and two representatives from D0L Occupational Safety and Health Administration (OSHA) on November 17, 1987.

3.0 Allegation of Improper Documentation of Airborne Exposure An alleger in a telephone call on October 29, 1987 to the NRC Region I office, alleged that a Health Physics technician was not recording his own exposure to airborne radioactive material in the Pellet Shop for the

third shift.

Inspector Review 1

The inspector reviewed the Daily Personnel Exposure Entry sheets for the HP technician, and discussed the allegation with the same individual.

The HP technician explained to the inspector that the majority of time in i the Pellet Shop was spent on second shift when the HP technician was j required to perform shift surveys and change air sample filters. l 4

Usually, limited time (less than 30 minutes) was spent in the Pellet Shop on the third shift. The HP technician stated that all of his exposure to airborne radioactive material was recorded on the Daily Personnel Exposure Entry sheets for the second shift. The inspector verified that the records of the exposures appeared accurate for the times that the inspector observed the HP technician in the Pellet Shop. Further, records were available for every day worked by the HP technician from September, 1987 to the date of the inspection. The inspector concluded that the allegation was not substantiated.

3 The inspector noted that there was a lack of supervisory oversight of documentation and recordkeeping, as evidenced by difficulties in document retrieval and incomplete information on many records. The licensee stated that their documentation and recordkeeping systems would be reviewed and revised in conjunction with the planned Radiation Protection program and procedure upgrades.

4.0 Allegation of Receipt of Contaminated Fuel Assembly An alleger, in a telephone call on November 5, 1987 to the NRC Region I office, alleged that a damaged and radioactively contaminated fuel assembly, that had been in a spent fuel pool, was received at Building 17, in April 1987, and that the licensee did not possess the proper authorization to receive the fuel assembly with this type of radioactive material.

Inspector Review The inspector requested the receipt surveys and the RWP and surveys taken to support the repair work on the fuel assembly, and conducted discussions with licensee personnel and former licensee personnel. The Health Physics technician who provided coverage for the job (a former CE employee) stated that extensive surveys were taken prior to and during the work on the fuel assembly. However, during the inspection, no survey documentation was found or provided to the inspector. The inspector stated that failure to maintain records of surveys required by 10 CFR 20.201(b) and 10 CFR 20.205(b) was another example of failure to maintain records as required by 10 CFR 20.401(b). This was cited previously in NRC Inspection Report No. 70-1100/87-05.

The inspector found that the licensee has an NRC-by-product license number 06-00217-06, which allows them to possess any by-product material in quantities not to exceed 51 curies. Therefore, the allegation of receiving radioactive matertal without the proper authorization was not substantiated.

5.0 OSHA Visit Allegations regarding industrial safety and industrial hygiene concerns were received by the NRC from licensee employees and evaluated as described in NRC Inspection Report No. 70-1100/87-05 (October 5-9 and 19-23,1987). As a result of these allegations, the NRC contacted the Occupational Safety and Health Administration (OSHA) Region I office for disposition of these matters. During this inspection, the inspector attended the opening conference between licensee management, the local union president, and the two OSHA representatives on November 17, 1987. The OSHA representatives stated that the purpose of their visit was to investigate allegations received by the NRC inspector. The results of the OSHA inspection will be transmitted by that agency.

4 6.0 Exit Interview The inspector met with the licensee's representatives (denoted in paragraph 1) at the conclusion of the inspection on November 18, 1987.

The inspector sumarized the purpose and scope of the inspection and findings ss described in this report.
