Recent deliberations of the' Commission and its Boards,on Seabrook , titer- ?j l
l native sites issues have led the Commission to conclude that the policy L '
statement in Enclosure A to SECY-78-163 should be reviewed in the light' 1
of the Co= mission's Seabrook decision of June 30, 1978, and amplified to ='
provide more specific guidance in certain areas. );.i The Cocsission requests amplification of the policy statement to provide !
guidance that would, as explicitly as possible, address the -following issues:

- 1. When a site is "obviously superior" (or when a criterion stated ;
differently but serving a similar function is met).

- 2. How many candidate sites to consider, with particular attention to -
acceptable methods for narrowing comparison studies to a relatively few sites.

- 3. Areas to include in alternative sites investigations, notably in W
relation to applicants' or lead applicants' service areas and state 1 i
boundaries, and the bearing of distances, population levels, appli- .
cants' total power capacities, total state and regional power demands, and power-pool arrangements.

- 4. The nature and extent of data and analyses required about' alternative f sites, including the extent to which any. site-dependent plant features need to.be worked out.
The amplified policy statement should be drafted as a proposed rule, with .
opportunity for public comment. The draft should be submitted for the -
Co: mission's consideration within three months. If it is necessary to supplement the proposed rule with a technical document that provides further explan'ation, the draft of any such document should be submitted for Commission review at-the same time, so that the document could be a issued simultaneously with publication of the proposed rule.
The Commission recognizes that the impending decision of the U.S. Court of Appeals for the First Circuit in the consolidated Seabrook cases may ha,ve a bearing on the work requested by this memorandum. After issuance of the. Court decision the Commission will provide further guidance, if ,
appropriate.
