Dear Dr. Kluth:

Your letter of October 2,1978 requesting infomation relative to an emergency preparedness agreement with the Perry Nuclear Power Plant has been referred to me for reply.

Generally the NRC does not attempt to outline in detail the form and substance of the agreements required by our regulations. This is due primarily to the fact that there is a wide variety of State, county and municipal organizations across the country with different authorities and responsibilities for emergency planning and pre-pa rednes s. The kind of infomation in such agreements which we find of value during our review of applications to operate nuclear power plants is set forth in one of our guidance documents for such applicants, Regulatory Guide 1.101 (copy enclosed). You may be particularly interested in the discussion in Section B and in Section 5.4 of Annex A of the guide which addresses the matter of coordination with agencies such as the Lake County General Health District.

In addition to the foregoing, the NRC in cooperation with a number of other Federal agencies, engages in a program of advice and assist-ance to State and local government agencies which addresses a broad spectrum of radiological emergency planning and response matters.

This has included the publication of a broad guidance document (NUREG-75/111), a copy of which is enclosed. We believe you should find this useful as you further develop your plans in this area, particularly when used in conjunction with coordinating your efforts with other Ohio State and county agencies and with the Perry facility.

As to your specific questions, we would encourage you to review the prop and disc,osed environmental radiation surveillance program for Perry uss its capabilities and utilization with the utility personnel.

We doubt that there will be justification for you to duplicate the program, but you may wish to supplement it in conjunction with a State agency. We do not believe that the Health District would be justified in maintaining a continuous air surveillance capability.

We do believe that our requirements for control and monitoring of releases by the facility will be adequate for this purpose.

Fred C. Kl uth, MD You also asked whether the Health District and other officials should operate from a center other than the offsite emergency center for the Perry plant. It is difficult for us to answer this particular question at this time in the absence of more specific information. When the Perry emergency plans are submitted for our review, which we anticipate will occur sometime next year, we will evaluate the l

proposed energency control centers as to their location, staff-ing, and communication capabilities. We would be happy to confer with you on this particular matter at that time.

With respect to the matter of exercises, we certainly do advise them, particularly insofar as they test the essential elements of emergency communication facilities and procedures, emergency personnel responses, and resource availability. You will note that both guidance documents enclosed address this matter, and that the NRC does require provisions for tests and exercises in the plans submitted for our review, We also require that they provide for an initial exercise prior to fuel loading and for annual exercises to test the capability of the emergency organization. Furthe rmore, we require that these exercises contain provisions for participation by emergency personnel of "offsite agencies" such as yours.

As to funding matters, we regret that at this time funds are not available from the NRC for direct assistance to the Health District.

However, federal training assistance and federal interagency assist-ance is available to you through the Ohio State Division of Disaster Services in Worthington, Ohio. You may contact Mr. James Williams of that organization for further information.
