RSPnSB Pending This refers to your request dated.Tuly 17, 1963, for AEC authorization to make Proposed Chanpc No. 40 in the Technical Specifications of Facility Iicense No. DPR-3 pursuant to the provisions of Section 50.59, 10 CFR 50.
The Proposed Change would authorize the replacement of the twenty-four presently installed nickel plated silver-in dium-cadmium control rods with twenty-two hafnium rods and two inconel clad silver-indiun-cadmium rods.
lic have reviewed the Proposed Change and have concluded that, subj ect to the conditions set forth below, the Proposed Change does not present signifiennt hazards considerations not described or inplicit in the hazards summary report, and that there is reasonabic assurance that the health and safety of the public will not be endansared.
A copy of our related hazarJs analysis is enclosed.
In view of the forcraint, Proposed Change No. 43 is herchy authori:cd pursuant to Section 50.59,10 CPR 50, subject to the following conditions:

"The plant shall he operated in a nanner so that control rod insertion will provide not less than 2* A k/k shutdown margin if the maximum worth rod is stuck in its fully withdraun position and the silver-indium-cadmium rods are stuck at their operating positions."

"The reactor shall not be operated at power with the new types of control rods installed until additional information re-garding the progran for functional testinr of the control rods prior to and during Core III life is su'mitted to the Con.nission and authorizat' a to use the control rods during power operation is franted."
