NOTICE OF SUPPtE*FMTARY ANTITPUST REVIEH OF OPEPATING LICENFE APPLICATICN On May 10, 1975, the Cincinnati Gas and Electric Company (CG8E), Coluebus t Fouthern Ohio Electric Company (C850E), and the Dayton Power a Light Company MPL) tendered their ,foint application to cbtain an cperating license for the Pm. H. Zinwer Nuclear Power Station, Unit 1. Antitrust information, dated A pril . 27,1977, was submitted in accordance with NRC Regulatory Guide 9.3 for evaluation by the NRC staff. Pased upon procedures then in effect, the WC P

staff conducted an internal review of this infermation and' concluded "that chances in the Applicants' activities occurring since the' construction permit antitrust review do not represent significent changes that would now warrant another antitrust review at the operating license stage."

In its evaluation, the staff took note of, among other things, the pending application by the American Electric Power Company, Inc. (AEP) to acquire CPSOE and the Initial Decision of an Administrative Law Judge cf the Securities ,

and Exchange Comission (SEC) on July 18, 1973, denying the proposed acquisition, based in part on ces. "titive consideraticns. The staff also noted the SEC's l

taking of review of the Initial Decision. The NRC staff was interested in the l l

Arrerican Electric Power Co. , Inc. , Docket 70 4596, Opinion of the Comission, dated July 21, 1978, and Supplemental Memorandum and Order Approving Acouisition of Comon Stock of Columbus and Southern Ohio Electric Ccepany by American Electric Power Company, Inc., dated February 13, 1980.

The staff is reevaluating its earlier finding of "no significant change" under Section 105c(2) of the Atomic Energy act of 1954, as amended, in light  !

of the accuisition of CASOE by AEP. The results of this reevaluation wil,1 be published in the Federal Register and copies sent to the Washington and local 4
