SUBJECT:

Notice of Violation and Proposed Imposition of Civil Penalty (NRC Inspection Report 50-285/87-27 EA-210)

Omaha Public Power District received the Notice of Violation and Proposed Imposition of Civil Penalty (Reference 2), which contained three Level III violations resulting from the findings of the Instrument Air Syst a Inspections. As a result of these inspections an enforcement conference was held in Arlington, Texas on October 29, 1987 and meetings were held in Bethesda, Maryland on November 5 and 13, 1987.

OPPD acknowledges the violations and does not contest the proposed civil penalty. Accordingly, pursuant to 10 CFR 2.205, please find attached a check in the amount of $175,000.

Since the above mentioned meetings, OPPD has actively pursued improvements specific to the Instrument Air System; however, programmatic improvements which address the more general concerns of the violation notice need add-itional management review.

To fully address these concerns, OPPD respect-fully requests a three week extension in respcnding to the Notice of Viola-tion. This extension was discussed with Mr. R. Mullikin of Region IV and Mr.

J. Fisicaro of my staff.
