(1) of the Atomic Energy Act, as amended, the analysis addresses the extent to which the specific criteria in Sections 127 and 123 are met, as well as certain additional fac-tors envisaged by Section 126 a.(1).

A detailed analysis for the European Community was submitted Decemoer 8, 1978 for NRC applications Nos.

XSNM01212, 1232, 1235 and 1241.

In view of Executive O rde r 1219 3, extending the duration of the period speci-fied in the first prcrtso to Section 126 a.

(2) of the Atomic Energy Act of 1954, as amended, to March 10, 1981, tnat detailed analysis remains valid.

The Executive 3 ranch, on the basis of its review of nese cases, has toncluded that the requirements of the Atomic Energy Act and ?.L.95-242 have been met and that the proposed export would not be inimical to the common def ense and security of the United States.

Moreover, the

There-fore, the Executive Franch recommends issuance of the re-quested export licenses.

The export of 484.408 kilograms of U-235 contained in 802.0 kilo-grams of uranium enriched to 60.4 percent in the form of uranium hexafluoride for manufacture of fuel elements for KNK-II Compact Sodium-Cooled Prototype Reactor Applicant:

October 13, 1978 Purpose of Export The export of the 302 kilograms of 60 percent en-riched uranium is to oe used for the third _ core loading of the KNK-II Compact Sodium-Cooled Prototype Reactor which was designed for fast breeder research and development pro-grams of the Government of the Federal Republic of Germany.

The owner / operator of the KNK-II is the Kernforschungscen-trum Karlsruhe (KFK).

The KNK-II is used for irradiation of test fuel ele-ments and for reactor safety and instrumentation tests.

The reactor coce contains both uranium oxide and mixed uranium and plutonium oxide fuel elements.

The KFK re-secrch is intendec to demonstrate the complete technical and saf ety feasici_ity of a large f ast breeder reactor, the commercial introduction of which will not come up for cecision in the FR3 until the 1990's.

Scecial Non-Proliferation and Otner Foreign Policy Consicerations l

The proposed expor: was approved by the President after revies by the SSC Ad Hoc Group determined that the request was within the scope of the President's HEU export policy, would not ce inimical to U.S.

common defense and security and met the recuirements of the Atomic Energy Act, as amended oy the Nuclear Son-Proliferation Act of 1978.

The KNK-II is a reactor designed for the fast breeder re-search and development program of the FRG, The U.S.

has sup-plied the HEU for two previous core loadings.

._.. proliferation concerns, KFK, the owner / operator of KNK-II, has redesigned :na fuel elements, to be fabricated out of the proposed expor: for the third core loading, in order-to eliminate the need for 93 percent enriched uranium in the test zone fuel elements.

The redesigned fuel elements utilize uraniur enriched to a maximum cf 60 percent.

In 1979, :ne Argonne National Laboratory (ANL) con-cluded that it sign: not be possible to reduce the level of enrichment of KNK-II fuel elements significantly lower than the current 60 percent without seriously affecting the performance of the reactor.

Justification of the Need for HEU at This Time A total of 302 kilograms of 60 percent enriched uran-ium has been requested for the third core loading plus spare fuel elements.

Approximately one and a half years are required for the conversion and fuel fabrication pro-cess.

Insertion of the third core is scheduled for January 1932.

Current availacle inventory of HEU at KFK is 141 kilo-grams.

The proposed export plus current inventory will equal approximatelv 940 kilegrams.

Of this amount, 500 kilocrams will ce 3 sed f or :he manuf acture of 28 core fuel elements; 140 kilc::ams will be used to fabricate 8 spare elements and 300 kilograms will represent fabrication sur-clus and productten scrap, most of wnich will be recovered

'and eventually usef in the fourth core loading of the KNK-II.

Consequently the HEU specifications indicated in our letter of November 20, 1978 should now read as follows:

a) 14.030 kilograms of U-235 centained in 15.038 kilograms of total uranium; b) 35.238 kilograms of U-235 centained in 50.125 kilograms of total urahium.
