REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR CERTAIN BABCOCK AND WILCOX OWNERS GROUP INFORMATION
Dear Mr. Henshaw,
By letter dated March 27,1997, you submitted FTl Document No. 51-1266113-00 (Proprietary),
- Post-LOCA Boron Concentration Management," dated March 1997 and requested that cer1ain information in the report be considered propnetary and withheld from public disclosure pursuant to 10 CFR 2.790. The information pertained to specific measured data for the affected plants.
You also submitted an affidavit, signed by James H. Taylor, Manager of Licensing Services for Framatome Technologies, Inc., dated March 27,1997, that supporied that request. The affidavit stated that the information has been held in confidence by the Owners Group and should be considered exempt from mandatory public disclosure. In the enclosed affidavit, you indicated that the information is considered proprietary for the following reasons:
(a)
The use of the information by a non-member would decrease his expenditures, in time or resources, in designing, producing or marketing a similar product.
(b)
The information consists of test data or similar data concoming a process, method, component, the application of which results in a competitive advantage to the B&WOG.
l (c)
The information reveals special aspects of a process, method, component or the like, the j
exclusive use of which results in an economic advantage to the B&WOG.
j' We have reviewed the information in accordance with the requirements of 10 CFR 2.790 and, on i
the basis of statements by B&WOG, have determined that the information sought to be withheld j
does contain proprietary commercial information.

Therefore, we have determined that the information identified as proprietary in the above i
document, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section l
103(b) of the Atomic Energy Act of 1954, as amended. You also submitted a nonproprietary version of FTl Document No. 51-1266113-00 which will be placed in the NRC public document 9y,/db mom Withholding from public inspection shall not affect the right, if any, of persons property and directly concemed to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
