Dear Ms. Skrutski:

This is in response to your letter dated October 5,1978 concerning the Appeal Board's desire to supplement the record in this proceeding with the following documents:

1) Collision Study for LNG Tankers, dated July 17, 1967, prepared for the Marathon Oil Co. by V. V. Minorsky.
2) Risk Assessment of LNG, Marine Operations for Raccoon Island, New Jersey, prepared for the Federal Power Commission by Science Applications, Inc. (both draft and final reports).
3) Unconfineo Vapor-Cloud Explosions, by Roger A. Strehlow (Fourteenth Symposium on Combustion (1973)).

The NRC Staff has no objection to the Appeal Board supplementing the record with these documents. However, since these documents have merely been referred to in a limited way in these proceedings by various witnesses and have not been made a part of the record or been subjected to any examination, we believe it would be inappropriate for the Appeal Board to rely on any of the conclusions stated in them. We have no -

objection to the Appeal Board's reference to or reliance on specific facts and data set forth in these documents which were referred to or relied on by any of the witnesses in this proceeding.
