i 103 and 185 of the Atomic Energy Act of 1954, as amended, for utilization facilities known as the Palo Verde Nuclear Generating Station, Units 4 and 5.

Palo Verde Nuclear Generating Station (PVNGS) is the name which has been given to a site situated in Maricopa County, Arizona, approximately 36 miles west of the western boundary of the City .

of Phoenix, at which Palo Verde Units 1, 2 and 3 are currently under construction, pursuant to Construction Permits Nos. CPPR 141, CPPR 142 and CPPR 143, respectively, issued in Dockets Nos. STN 50-528, STN 50-529 and STN 50-530, respectively.

Subject to the receipt of approvals and authorizations required by law, Palo Verde Units 4 and 5 will be jointly owned by the joint-applicants listed below, sometimes referred to as " Par-ticipants," as tenants in common with undivided ownership in-terests in the respective percentages hereinafter set forth:

Nevada Power Company (NPC) 2.2%

Department of Water and Power of the City of Los Angeles (LADWP) 11.7%

City of Anaheim, California (Anaheim) 1.5%

City of Burbank, California (Burbank) 1.0%

City of Glendale, California (Glendale) 1.0%

City of Pasadena, California (Pasadena) 1.0%

City of Riverside, California (Riverside) 1.0%

Pursuant to the Amended Replication Agreement, dated as of February 1, 1978, between the joint applicants (a copy of which is included as Appendix 1A to Section 1 of the General Informa-tion submitted herewith pursuant to 10 CFR Part 50.33), APS has been designated as the Project Manager and Operating Agent of Palo Verde Units 4 and 5, and in such capacities is responsible for the engineering, design, construction, quality assurance, operation, and maintenance of such units and is authorized to submit and prosecute on its own behalf and the behalf of all the joint applicants all applications for any permits, licenses, authorizations, and approvals requisite to the engineering, design, construction, quality assurance, operation, and main-tenance of such units. -

struction permits and operating licenses authorizing APS to construct, operate and maintain Palo Verde Units 4 and 5 on its own behalf and as agent for all other joint applicants and authorizing all joint applicants to acquire and own undivided interests in each of said units as tenants in common in the percentages hereinabove set forth.

Consistent with the Commission's announced policy encouraging standardization ~of nuclear power plants, Palo Vdrde Units 4 and 5 will be replicates of Palo Verde Units 1, 2 and 3 (the

" Base Plants"), and this application is submitted in accord-ance with the replication procedures described in WASH-1340.

Pursuant to such procedures, a request for initiation of a qualification review of the Base Plants to determine the acceptability of their design for Palo Verde Units 4 and 5 was submitted by Reference (2). As set forth in Reference (4),

the Commission's staff conducted the requested qualification review and found that'the Base Plant design pas acceptable for Palo Verde Units 4 and 5 subject to (i) the appropriate address in the Palo Verde Unit 4 and 5 Preliminary Safety Analysis Report (PSAR) of safety issues in several identified categories and (ii) the expressions of the staff's intent

- respecting the review and design requirements for Palo Verde Units 4 and 5 in relation to the Base Plants. In this con-nection, the joint applicants acknowledge again that the success of replication is dependent upon holding design changes to an absolute minimum and are committed to make every_ effort to limit changes solely to those necessary to resolve any significant safety issues that may be identified in the future and are applicable to Palo Verde Units 4 and 5.

In support and as a part of this joint application, APS sub-mits the General Information Required by Section 50.33 and Appendix C of 10 CFR Part 50 and the following parts:

Part 1: Information Requested by the Attorney General for Antitrust Review.

Part 2: Palo Verde Nuclear Generating Station Units 4 and 5 Preliminary Saf ety Analysis Report (PSAR).

Part 3: Palo Verde Nuclear Generating Station, Units 4 and 5 Environmental Report (ER).

Pursuant to the exemption granted by Reference (3), Part 1 as submitted herewith includes the antitrust information re-

_s quired by 10 CFR Part 50, Appendix L and Regulatory Guide 9.2 for APS, SCE and EPE. As stated in Reference (2), APS, SCE and EPE offered participation in Palo Verde Units 4 and 5 to 781TO2' 3

all electric utilities serving the public in western Texas, -

New Mexico, Arizona, southern Nevada and southern California.

As a result of such offer and subsequent negotiations, the joint applicants other than APS, SCE and EPE have recently determined, subject to the prior _ satisfaction of certain applicable statutory requirements, to become participants in Palo Verde Units 4 and 5. However, since making such de-termination, such other joint-applicants have not had suf-ficient time to prepare the entitrust information required by 10 CFR Part 50, '?pendix L and Regulatory Guide 9.2, and request that the time within which they may submit such in-formation be extended to July 1, 1978. In support.of such request, .such other applicants assert that the refusal to grant the request would defeat the primary purpose'of Section 105 of the' Atomic Energy Act of 1954, as to which the informa-tion requirements of 10 CFR Part 50, Appendix L and Regula-tory Guide are intended to emplement.

The antitrust information tquired by Regulatory Guide 9. 2 respecting APS, SCE and EPE has been submitted under separate cover to the Antitrust and Indemnity Group of the Office of Nuclear Reactor Regulations.

As required by Reference (4) and committed by Reference (5),

the Palo Verde Units'4 and 5 PSAR, submitted as Part 2 with this joint application, physically incorporates the Palo Verde Units 1, 2 and 3 PSAR, as amended through Amendment No. 17.

Each of the items in the several categories of safety issues identified in Reference (4) has been or will be addressed in the nanner set forth in Reference (5).

Additionally, it should be noted that the Palo Verde Unit 4 and 5 PSAR follows the " Reference System" concept set forth in Appendix 0 of 10 CFR Part 50 and incorporates by reference the Combustion Engineering, Inc. Standard Safety Analysis.

l Report (CESSAR) as amended for which a Preliminary Design i Approval was issued in NRC Docket No. STN 50-470 c.- December l 31, 1975, and is currently effective through Decccrer 31, 1978. The manner in which CESSAR is incorporated by refer-ence is explained in Section'l.7 of the Palo Verde Units 4 and 5 PSAR.

The Palo Verde Units 4 and 5 Environmental Report (ER) sub-mitted with this joint application as Part,3, is complete except for those sections dealing with (i) the need for power,

! (ii). transmission line environmental impacts, (iii) evaluation j of alternative water scurces, and (iv) those portions of the

! cost-benefit analysis dependent upon the need for power,

! transmission line and alternative water sources evaluations. -
