Dear Mr. Graesser:
This will acknowledge receipt of your letter dated March 26, 1997, and your check for $100,000 in payment for the civil penalties proposed by NRC in the Notice of Violation and Proposed Imposition of Civil Penalties (Notice) dated February 27, 1997.
The NRC has performed a preliminary review of your response to the Notice and it appears that your response was inadequate. Specifically, during the inspection, it was found that the Byron Technical Specification (TS) 3.7.5
" Ultimate Heat Sink" which stated "... minimum water level in the cooling tower basin of 873.75 feet Mean Sea Level..." was inadequate. Although we noted that you made administrative changes to increase the level, committed to re-perform ultimate heat sink calculations, and u change the TS was not addressed in your response.pdate the UFSAR; the need to We believe that the current TS needs to be changed to reflect the current design of the cooling tower basins.
Therefore, we request that you provide a supplemental response to the Notice within 30 days from the date of this letter to include a description of any action you have taken or plan to take to correct the TS and when that action I g) will be completed.
