DELEGATION OF AUTHORITY TO THE DI EETOR OF NMSS TO APPROVE ACTIONS UNDER PUBLIC LAW 95-604 Purcose:

To request the Commission delegate to me the respon-sibilities for advice and concurrence to the Department of Energy in remedial actions required by Public Law 95-604 (the Uranium Mill Tailings Radiation Control Act of1978)

Discussion:

Under Title I of Public Law 95-604, the Department of Energy is required to take certain remedial actions necessary to prevent or minimize hazards associated with designated inactive mill tailings.

The Commission is required to provide concurrence in these remedial actions.

The-first, in a series of approximately 20 concurrence actions on each of the 22 inactive sites which are the focus of the remedial actions, has been received (see ).

All of the actions are similar in nature 06 actions routinely performed in licensing active milis under my current delegated authority. is an example of the type of concurrence required of the Commission under PL 95-604 and gives an indication of the minor nature of many of the actions requiring Commission concurrence. is the proposed new delegation of authority, which will be in addition to that set forth in the Celegation of Authority dated June 16, 1975 and which will amend tnat Delegation of Autnerity.

The June 16, 1975 Delegation of Authority appears at Enclosure 3.

Recomenda tion :

I recomend that the Commission delegate responsibilities for concurrence in DOE remedial actions pursuant to PL 95-604 to me.

Specifically, I recomend Item 18 of be added to my current list of delegated responsibilities.

Coordination :

The Office of the Executive Legal Director has no legal objections.
