HMs3, ;.dCTION and discharge an effluent to Joachim Creek, Upper Mississippi Basin. This pro-ject was the subject of public notices issued by the Department of Natural Resources on January 13, 1978 and June 9, 1978, our public notice MO-0000761.
The hearing will be conducted November 30, 1978 at 1:00 p.m. at the Fine Arts Theater, Fine Arts Drive, Jefferson College, Hwy 21, one mile north of Hillsboro, Mo.
The purpose of the hearing will be to address objections filed with the agency.
The people who commented have questioned the discharge of nuclear materials to Joachim Creek. The Missouri Clean Water Commission has advised the people who commented that the matter of the permit for discharge of nuclear materials lies with the federal government at this time.
As we interpret the recent Supreme Court decisions, the discharge of nuclear materials is the sole responsibility of the Nuclear Regulatory Commission.
The Clean Water Commission will be conducting the hearing to secure a transcript for the record, but the matter of the permit for the discharge of the special nuclear material lies within the jurisdiction of the federal government.
The Nuclear Regulatory Commission will attend the hearing and will precent testimony on the Nuclear Regulatory Commission permit that has been issued to Combustion Engineering and will discuss data collected in the past on the discharge 1
from the facility. The Clean Water Commission, in furtherance of the policy 1
as expressed in the Missouri Clean Water Law to protect the quality of the waters of the state, is interested in this matter and is conducting this hearing for the purposes of investigations and information for the Commission.

e The hearing will be conducted pursuant to Section 204.026(11) RSMo. and Section 204.066 RSMo. (Supp. 1975) before the Missouri Clean Water Commission; the rules and procedures for conduct of the hearing are specified in the Fussouri Clean Water Law, Section 204.006-204.141 RSMo. and Administrative Procedure Act, Chapter 536 RSMo.

Persons wishing to present oral testimony at the hearing should notify the Director of Staf f of the Missouri Clean Water Commission, by writing to the above address, by November 23, 1978.
Persons wishing to present written testimony may do so by submitting their testimony to the Director of Staff by December 7,1978.
Persons wishing to present testimony at the hearing should keep their presentation to a maximum of five minutes.
If additional time is required to present their facts, a written transcript should be prepared and submitted for the record, and a five minute summary presented to the commission.
