This is in response to your letter of September 28, 1978 requesting interim relief from the requirement of 10 CFR 70.58(i)(2) in regards to combustible waste. We understand that this request is necessary due to a shutdown of your incinerator facility in January 1978 due to an operating incident.

We have found your proposal for long term storage of combustible waste as feed to a new incinerator facility acceptable ,up to a '

period ending November 15, 1978.

Specific approval cannot be given for approval beyond the November 15, 1978 date until additional data is provided by you. It is our under-standing that the additional data will be provided for our review on or before November 15, 1978.

We have determined that your request for interim relief, to November 15, 1978, from the requirements of 10 CFR 70.58(i)(2) will not endanger the common defense and security and is otherwise in the public interest,.

Accordingly, new License Condition 4.7 is added to Amendment MPP-2 to your License No. SNM-1097 to read as follows:

4.7 "Notwithstanding 10 CFR 70.58(i)(2), the licensee may accumulate combustible waste generated in his plant which has been measured to an uncertainty exceeding + 10 per cent for the period to November 15, 1978. Upon receipt of additional specific data, if on or before November 15, 1978, this period will be extended, but will not exceed one year from this date or until November 15, 1979."

In addition to the details you list in your letter of September 28, 1978 it will be necessary to include specific information which describes the impact of the accumulated waste on the measured material balance including an estimate of measurement accuracy of the material, MUF and LEMUF.

General Electric should incorporate any new, approved procedures for the incineration of combustible waste in the Measurement Control Plan required by 10 CFR 70.57 which must be included in either Chapter 4.0 or Appendix C of General Electric's Fundamental Nuclear Material Control Plan (10 CFR 70.58). .
