Gentlemen:
General Atomics (GA) possesses two TRIGA research reactors under Nuclear Regulatory Commission (NRC) License Nos. R-38 and R-67, and conducts operations involving the possession of special nuclear material under NRC License No. SNM-696. In compliance with 10 CFR Parts 50.33 and 70.25, GA previously submitted financial assurance for the estimated cost t ' decommissioning its reactors and its SNM-696 licensed facilities (Refs.1 & 2). The financial assurar.ce was provided by a parent company guarantee based on the financial test contained in Appendix A of 10 CFR 30.
Subsequently, for reasons detailed in Reference 3, GA was and is, in non-compliance I
with the applicable NRC financial assurance regulations (10 CFR 50.75 and 70.25). As a consequence, G % proposed that an alternate method of compliance be approved by the NRC I

j information, the NRC agreed to exercise its discretion and forbear enforcement; provided, l
however, that should circumstances materia!!y change such that GA's parent would be able to j
qualify under the regulations to provide a guarantee for the full amount of the estimated costs of l
decommissioning, this forbearance shall cease (Ref. 4).

i The guarantee included a commitment by General Atomic Technologies Corporation i~
(GATC), the parent guarantor, to submit revised financial statements, financial test data, and a i
special auditor's report and reconciling schedule annually within 90 days of the close of the
_ parent guarantor's fiscal year. Accordingly, submitted herewith is said information for 1996.
l This same information demonstrates that the circumstances described in Ref. 3 have not changed l
materially (and GA's parent does not qualify under the regulations to provide the necessary j
guarantee).

l As set forth in the enclosed affidavit of Mr. Jones, GATC requests that this information l
l be treated as proprietary information under the provisions of 10 CFR 2.790. GATC is a privately l
held corporation and the enclosed financial statements contain sensitive financial information.
