Dear Ms. Curtin:
1 I am writing in reference to your letters of November 4,1978, to the Secretary and the Executive Legal Director of the Nuclear Regulatory Commission (NRC). In these letters, you state that " Concerned Citizens i for Safe Energy, Inc. would like to intervene in the New Haven I and New Haven II siting proceedings." You also request copies of all notices associated with this proceeding and a copy of 10 CFR 52.713.
An application for construction permits for the New Haven facilities was submitted on November 22. This application must undergo an acceptance review by the Staff before it can be docketed. If it is found to be acceptable for docketing, a " Notice of Hearing on Application for Con-struction Permits" will be published in the Federal Register. Pursuant to the regulations of the NRC at 10 CFR 62.714, any person whose interest may be affected by this proceeding and who desires to participate as a party may file a written petition for leave to intervene. The petition for leave to Mervene must be filed within the time specified in the notice of haaring. We will send you a copy of the notice of hearing.
On December 13, 1978, a meeting will be held in New Haven, at which members of the NRC Staff will explain the procedures to be followed in connection with review of the New Haven application for construction permits. You or other representatives of Concerned Citizens for Safe Energy may wish to attend this meeting.
Enclosed for your information is a copy of 10 CFR Part 2, which includes 10 CFR 2.713, the section you requested.
