NUCLEAR REGULATORY COMMISSION

[ )h P'/g j

) E REGloN 811 5-7ee noosEvELT noAo-f GLEN ELLYN, ILUNol$ 60137 DEC 131978

> l i

Dear Mr On November 15, 1978, I sent you information describing three approaches tried by the NRC staff for evaluating the regulatory performance of operating nuclear power plants. One of these approaches was called the " statistical method." It was based on evaluating two measures of performance - the t. umber of non-compliance findings and the number of events considered directly controllable by the licensee. With the information sent you were the results of the statistical method evaluation for forty operating plants or sites based on data for 1976.

Enclosed with this letter is additional information developed in the trial of the statistical method. The enclosed informa-tion -- a copy of an October 26, 1977 memorandum entitled LICENSEE INSPECTION AND ENFORCEMENT INDICATORS UPDATE -- is based on noncomp11ance data (not event data) for the period January 1, 1976 through June 30, 1977 and for the period January 1,1977 through June 30, 1977.

As was discussed in the information previously sent you, the purpose of licensee regulatory performance evaluation, if successful, is to give NRC staff the ability to distinguish between levels of licensee regulatory performance. This could lead to more effective use of the agency's inspection and enforcement resources and to identification of plants that need further examination by the agency.

Sincerely, i

James G. Kepp er Director
