SUBJECT: NRC INSPECTION REPORT NO. 50-461/96009 AND NOTICE OF VIOLATION

Dear Mr. Connell:

On December 12,1996, the NRC completed an inspection at your Clinton Facility. The

enclosed report presents the results of that inspot.: tion.

During the period covered by this inspection, activities at the, Clinton facility were focused

on safe shutdown plant operations. Our observations identified a number of concerns

including several violations.

Most of these violations involved the adequacy of procedures and personnel adherence to

procedures. NRC inspectors also identified that your method of maintaining active license

status for the staff assistant shift supervisor position did not meet the requirements o' 10

CFR 55. We understand that you have reviewed the license status of your operators tnd

those considered inactive have completed the necessary time under instruction.

l enclosed Notice when preparing your response, in your response, you should document

j the specific actions taken and any additional actions you plan to prevent recurrence. Your

. response may reference or include previous docketed correspondence if the

future inspections, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.

j in addition, two apparent violations were identified and are being considered for escalated

enforcement in accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions" (Enforcement Policy), NUREG-1600. These violations involve the
corrective actions taken for repetitive foodwater check valve test failures and test

. methodology concerns. These problems resulted in an apparent inoperable condition of

containment penetrations during the fuel cycle following RF-5. Accordingly, no Notice of

advised that the number and characterization of apparant violations described in the

enclosed inspection report t.my change as a result of further NRC review.

A predecisional enforcement conference to discuss these apparent violations has been

scheduled for March 4,1997, at 10 a.m. The decision to hold an open predecisional '

enforcement conference does not mean that the NRC has determined that a violation has

occurred or that enforcement action will be taken. This conference is being held to obtain

information to enable the NRC to make an enforcement decision, such as a common

understanding of the facts, root causes, missed opportunities to identify the apparent

violations sooror, corrective actions, significance of the issues and the need for lasting and

effective corrective action, in particular, we expect you to provide assurance that

feedwater check valves will remain operable for one operating cycle. In addition, this is an

opportunity for you to point out any errors in our inspection report and for you to provide

any information concerning your perspectives on 1) the severity of the violations, 2) the

application of the factors that the NRC considers when it determines the amount of a civil l

penalty that may be assessed in accordance with Section VI.B.2 of the Enforcement

Policy, and 3) any other application of the Enforcement Policy to this case, including the

exercise of discretion in accordance with Section Vll.

You w'ill be advised by separate correspondence of the results of our deliberations on this

matter. No response regarding these apparent violations is required at this time,

in accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter,

the enclosures, and your response to this letter will be placed in the NRC Public Document

j Room. To the extent possible your response should not include out personal privacy,

proprietary, or safeguards information so that it can be placed in the PDR without

redaction.
