INTERPRETATION OF 10 CFR PARTS 50.72 AND 50.73 FOR PARTIAL SPURIOUS REACTOR SCRAMS DURING SHUTOOWN (TAC NO. 66507)

We have reviewed your letter dated October 12, 1987 (P-87358) requesting an interpretation of 10 CFR 50.72 and 50.73.

Your request concerned the applicability of reporting partial reactor scrams during shutdown under these regulations.

In considering your letter, we reviewed it against both the referenced regulations, and the Statement of Considerations originally published at 48 FR 39039 on August 29, 1983.

We also considered our previous inspection of the spurious responses of the Fort St. Vrain Plant Protective System, discussed in Inspection Report 50-267/87-12.

It is the staff's position under 10 CFR 50.72 and 50.73 to require that all manual or automatic actuations of the reactor scram system, with the exception of those that are preplanned, be reported.

This includes the situations in which control rods may already be inserted as described in your letter.

Our review of 10 CFR 50.72 and 50.73 reports from operating plants shows that the industry, in general, similarly interprets the regulation.

We therefore request that you continue to report all reactor scram events not resulting from or part of a preplanned sequence during testing or reactor operation.
