Dear Mr. Coggins:

This refers to the proposed use of licensed materials at the Weeks Bay National Estuarine Research Reserve, Baldwin County, Fairhope, Alabama. Upon consulting with Mr. Adams and the State of Alabama, it appears that the Research Reserve comes under Alabama jurisdiction rather than Nuclear Regulatory Commission for regulation of licensed byproduct material. I am retuming the materials you submitted.

Section D, " Standards for Protection Against Radiation," Section J, " Notices, Instructions and Reports to Workers: Inspections," and Section T, " Transportation of Radioactive Material."

12. Licensed material shall be used by, or under the supervision ofindividuals designated by the Mississippi State University Nuclear Energy Committee, ano Terry L. Coggins, Radiological Safety Officer.
13. Licensed material may be used only on the Mississippi State University properties. Licensed material contained in nuclear moisture / density gauges must be stored in an area designated and approved by the Mississippi State University Radiological Safety Officer.
14. A. (1) Each sealed source or detector cell containing licensed material, other than Hydrogen-3, with a half-life greater than thirty (30) days and in any form other than gas shall be tested for leakage and/or contamination at intervals not to exceed six (6), months, except that each source designed for the purpose of emitting alpha particles shall be tested at intervals not to exceed three (3) months. In the absence of a certificate from a transferor indicating that a test has been made within six (6) months prior to the transfer, a sealed source or detector cell received from another person shall not be put into use until tested.

(2) Notwithstanding the periodic leak test required by this condition, any licensed sealed source or detector cell is exempt from such leak tests when the source or detector cell contains 100 microcuries or less of beta and/or gamma emitting material or 10 microcuries or less of alpha emitting material.

(3) Except for alpha sources, the periodic leak test required by this condition does not apply to sealed sources that are stored and not being used. The sources excepted from this test shall be tested for leakage prior to any use or transfer to another per son unless they have been lesk tested within six (6) months prior to the date of use or transfer.

B. Each encapsulated plutonium source designed for the purpose of cmitting neutron or gamma radiation shall be tested for leakage at intervals not to exceed six (6) months. The test shall be capable of detecting the presence of 0.005 microcurie of alpha contamination on the test sample.

C. Each sealed source or detector cell fabricated by the licensee shall be inspected and tested for construction defects, leakage, and contaminatica prior to use or transfer as a sealed source or detector cell. If the inspection or test reveals any construction defects or 0.005 microcurie or greater of contamination, the source or detector cell shall not be used or transferred as a sealed source until it has been repaired, decontaminated and retested.

D. The test shall be capable of detecting the presence of 0.005 microcurie of radioactive material on the test sample. The test sample shall *o e taken from the sealed source or detector cell or from the surfaces of the device in which the sealed source or detector cell is permanently or semipermanently mounted or stored on which one might expect contamination to accumulate. . Records of leak test results shall be kept in units of microcuries and maintained for inspection by the Division of Radiological Health, Mississippi State Department of Health.

E. If the test required by Subsection A., B., or C. of this condition reveals the presence of 0.005 microcurie or more of removable contamination, the licensee shall immediately withdraw the sealed source or detector cell from use and shall cause it to be decontaminated and repaired or to be disposed ofin accordance with the Mississippi State Board of Health Regulations for Control of Radiation. A report shall be filed within five (5) days of the date the leak test result is known with the Division of Radiological Health, Mississippi State Department of Health, P. O. Box 1700, Jackson, Mississippi 39215-1700 describing the equipment involved, the test rer"" .M the corrective action taken.

F. Tests for leakage and/or contamination shall be performed by the Radiological Safety Officer, or his designee, or by other persons specifically authorized by the Mississippi State Depsutment of Health, the Nuclear Regulatory Commission or another Agreement State to perform such services.

15. A. Detector cells containing titanium tritide foil shall only be used in conjunction with a properly operating temperature control mechanism which prevents foil temperatures from exceeding 225 degrees Centigrade.

B. Detector cells containing scandium tritide foil shall only be used .in conjunction with a properly operating temperature control mechanism which prevents foil temperatures from exceeding 325 degrees Centigrade.

! Detector cells containing Nickel-63 plated sources shall only be used in conjunction with a properly C.

operating temperature control mechanism as specified by the gas chromatography manufacturer.

provided in the Mississippi State Board of Health Regulations for Control of Radiation, Section  !

801.D.203(a)(1), the licensee is hereby authorized to label detector cells and cell baths, containing licensed j material and used in gas chromatography devices, with conspicuously etched or stamped radiation caution symbols without a color requirement.

18. The licensee shall not use licensed material in or on human beings or in field applications where activity is released except as provided otherwise by specific condition of this license.
19. Experimental animals administered licensed materials or their products shall not be used for human consumption.
20. A. Individuals involved in operations which utilize, at any one time, more than 100 millicuries of Hydrogen-3 in a non-contained form, other than metallic foil, shall have bicassays performed within one (1) week following a single operation and at weekly intervals for cont int.wg operations.

B. (1) Tritium shall not be used in such a manner as to cause any individual to receive a radiation exposure such that urinary excretion rates exceed 28 microcuries of tritium per liter when averaged over a calendar quarter.

(2) A report of an average concentration in excess of the limit specified in B.(1) above for any individual shall be filed, in writing, within thirty (30) days of the end of the calendar quarter with the Division of Radiological Health, Mississippi State Department of Health, Post Office Box 1700, Jackson, Mississippi 39215-1700.

(3) The report shall contain the results of all urinalyses for the individual during the calendar quarter, the cause of the excessive concentrations, and the corrective step; taken or planned to assure against a recurrence.

(4) Any single urinalysis which discloses a concentration of greater than 50 microcuries per liter shall be reported, in writing, within seven-(7) days of the licensee's . receipt of the results, to the Division of Radiological Health, Mississippi State Department of Health.

21. Individuals involved in frequent operations (less than every two weeks) which utilize, during any one (1) quart:r, a total of ten (10) millicuries of Iodine-125 and/or Iodine-131 in capsule form or a total of one (1) millicurie of liquid Iodine-125 and/or Iodine-131 must have a bioassay performed within six (6) to seventy-two (72) hours following the use of the licensed material. Infrequent use of Iodine-125 and/or Iodine-131 (greater than every two weeks) will necessitate a bioassay within ten (10) days following the use of the licensed material. Bioassays may be either in vivo or in vitro measurements; however, the licensee must maintain on file bioassay procedures and results for review by the Division of Radiological Health, Mississippi State Department of Health.
22. The licensee shall conduct a physical inventory every six (6) months to account for all sealed sources received and possessed under the license. The records ofinventories shall be maintained for two (2) years from the date of the inventory for inspection by the Division of Radiological Health and shall include the quantities and kinds of radioactive material, location of sealed sources, and the date of the inventory.

23. Individuals who work in or frequent any portion of a restricted area shall receive instructions as specified in Section 801.J.12 of the Mississippi State Board of Health Regulations for Control of Radiation at the time of employment and at intervals not to exceed twelve (12) months thereafter.
24. The specified possession limit includes all licensed material possessed by the licensee under this license whether in storage, held as waste, or otherwise in use.
25. Pursuant to the Mississippi State Board of Health Regulations for Control of Radiation, Sections 801.D.106 and 801.D.302, the licensee is authorized to dispose of Carbon-14, Hydrogen-3, Iodine-12 T. Sulfur-35, Iodine-131, Phosphorus-32, Technetium 99m, Chlorine-36, Selenium-75, Iron-55, Cobalt-57, and Chromium-51 by incineration provided the gaseous effluent from the incineration does not exceed the limits specified for air in Appendix A, Table II, Section D. Ash residues may be disposed of as ordinary waste provided the concentrations of licensed material appearing in the ash residues do not exceed the concentrations (in terms of micrxuries per gram)specified for water in Appendix A, Table II, Section D.
26. Sealed sources containing licensed material shall not be opened.
27. The licensee shall instruct all users of radioactive material listed in Item Nos. 6.J. through 6.M. that any maintenance or repair on the gauges involving removal of the source holders shall be performed only by the device manufacturer or by other persons specifically authorized by the Nuclear Regulatory Commission or an Agreement State to perform such services.
28. The licensee is authorized to hold radicactive material with a physical half-life of less than 75 days for decay-in-storage before disposal in ordinary trash provided:

A. Radioactive waste to be disposed ofin this manner shall be held for decay a minimum of ten (10) half-lives.

B. Before disposal as normal waste, radioactive waste shall be surveyed to determine that its radioactivity )

cannot be distinguished from background with a typical low-level laboratory survey instrument. All ,

radiation labels shall be removed or obliterated, j

29. Prior to the use oflicensed material on property not owned by Mississippi State University, or prior to the use of licensed material in such a manner as to cause dispersal of licensed material onto property not owned by Mississippi State University, a written notice must be submitted to the Division of Radiological Health, Mississippi State Department of Health, P. O. Box 1700, Jackson, Mississippi 39215-1700. The notice must include the isotope (s) to be used, the activity and form of each isotope, and the propased date and location of use.
