Dear Ms. Snow:

The parties are aware of the questions raised by the Nuclear Regulatory Ce ion's General Counsel regarding the representation of Congressman s

De11uns in this procWing by one or more of the Congressman's admini-strative aides.

By letter to the Board dated May 24, 1978, Congressman Delluns informed us that, as of that time, he had solicited the opinions of the Attorney General of the United States and the Select Camrittee on Ethics of the House of Representatives concerning this matter.

The letter also states the Congressman's intention to be " bound by" the determinations of those offices on this issue.

Subsequently, however, by letter of June 12, 1978, Congressman Dellums requested this Board to "detenIdne that my staff is indeed capable of representing me in these preceedings". That request is still before us.

Cn two separate occasions, each occurring some renths ago, Congressman Dellums' administrative aide orally assured the Board Chairman that the requested responses from the Attornev Ceneral and the Ethics Committee m uld be prcmptly forwarded to the Board. We were told that one of the requested responses had been received by the Congressman, and that receipt of the other was then iminent. The Board has yet to receive either of the precised responses.
