LICENSEE'S RESPONSE TO FRANK ALLER'S MOTION TO WITHDRAW REQUEST FOR HEARING In response to a confirmatory Order issued by the Deputy Ex-ecutive Director for Regional Operations on November 5, 1987, J.
Mr. Frank Aller filed a Request for Hearing on December 4, 1987.
c On December 21, 1987, Licensee GPU Nuclear Corporation filed a reply opposing Mr. Aller's request because it was premature, and recommended that it be denied.
On January 29, 1988, an Atomic Safety and Licensing Board was appointed to rule on Mr. Aller's

On February 25, 1988, Mr. Aller filed with the Licensing Board a "Motion to Withdrav Request for Hearing."
The motion is based upon an explanation of the Confirmatory Order provided in a letter of February 22, 1988, from the Deputy Executive Director for Regional Operations to Mr. Aller's counsel.
The letter re-fers to a meeting between the NRC Staff and Mr. Aller's counsel, and apparently other discussions were held between Mr. Aller and 8003040022 800229 PDR ADOCK 05000219 PDR g

r Licensee was not invited to nor made aware of the meeting between the Staff and Mr. Aller's counsel, and did not partici-l pate in the discussions between them which led to the February 22

Consequently, Licensee remains unable to appreciate the

need and the underlying rationale for the explanation provided in the letter.
Nevertheless, because the hearing request was preme-i ture and therefore unnecessary, Licensee concurs in the granting of Mr. Aller's motion to withdraw the hearing request.
