Dear Mr. Hamlin:

This is in response to your letter dated September 21, 1987, in which you requested, pursuant to the Freedom of Information Act (FOIA), a copy of the November 3,1983, closed Comission meeting transcript on Diablo Canyon.

The review has been completed, and it has been determined that, with the exception of page 3 which you provided in your letter, the transcript is exempt from mandatory public disclosure.

In accordance with subsection (k) of 5 U.S.C. 552b, the remaining portions of the transcript are being withheld pursuant to Exemption 10 of the Government inthe$unshineAct,5U.S.C.552b(c)(10)and10CFR9.104(a)(10)ofthe Comission's regulations. The discussion contained in the transcript l

addresses formal agency adjudications and sensitive procedural matters.

Pursuant to 10 CFR 9.25(c) of the Comission's regulations, it has been detemined that the infomation withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. John C.

Hoyle, Assistant Secretary of the Comission.

This denial may be appealed to the Secretary of the Comission within 30 days from the receipt of this letter. As provided in 10 CFR 9.29(a) any such appeal must be in writing, addressed to the Secretary of the Comission, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an "Appeal from an Initial FOIA Decision."
