Fpri1 4,1997 EN 97-029 0FFICE OF ENFORCEMENT.

NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Entergy 0)erations, Inc.

(EA 96-512)

Arkansas luclear One Docket Nos. 50-313: 50-368 Sub.iect:

PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of. Civil Penalty in the amount of $50,000 will be issued on or about April 9, 1997, to Entergy Operations Inc., for violations related to an October 17, 1996 containment building fire at the company's Arkansas Nuclear One facility.

The action is based on a Severity. Level III problem consisting of: 1) a failure to maintain an adequate lube oil collection system for reactor coolant pumps, which resulted in oil accumulation on fibrous insulation, creating the potential for a fire: and 2) a failure in two instances to take prompt action to identify and correct conditions which resulted in the fire.

In accordance with the Enforcement Policy, a base civil penalty in the amount of $50,000 is considered for a Severity Level III problem occurring prior to November 12, 1996.

Because this was not the first escalated enforcement action within 2 years, the staff considered whether credit was warranted for Identification and Corrective Action. The staff determined that credit was not warranted for Identification because the issues became known as a direct l

result of the fire and the licensee had opportunities to identify and correct l

conditions that led to the fire. The staff determined that Corrective Action credit was warranted in that corrective actions, once the violations were identified, were prompt and comprehensive. This assessment resulted in a base i

penalty.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice April 9,1997 Telephone Notification of Licensee April 9,1997 L

The State of Arkansas will be notified.

l The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted.

mitigated, or imposed by Order.
