Dear Administrative Judges:

Enclosed is an " Agreed Protective Order" which Applicant and Intervenors Rorem et al. request that you enter. Under the " Agreed Protec Ev FOrder", Intervenors will supply to Applicant's attorneys the documents which Intervenors previously sent in sealed envelopes to the Commission on April 3, 1986. Applicant has agreed to In-tervenors' terms for such disclosure, namely that the documents and the " protected information" contained in the documents will be restricted to Applicant's attorneys ,

and not communicated to anyone else (including our client). l Applicant's attorneys will sign the attached " Affidavit i of Nondisclosure" prior to receiving this information. l l

The proposed Agreed Protective Order does not  !

apply to the NRC Staff. Negotiations between Intervenors and the Staff concerning these documents may continue. Based on discussions with NRC Staff counsel, I believe that the 8604280149 860421 f ADOCK 05000456.

- l Staff has no objection to the entry of this two-party Agreed Protective Order.

The Agreed protective Order is not meant to address the use of " protected information" during the hearings, nor is it meant to preclude Applicant or the NRC Staff from requesting the Licensin'g Board (or the Commission, i if appropriate) to modify the terms of this Agreed Protective Order or to permit or require further disclosure of such information.

Applicant respectfully requests that the Licensing Board approve this Agreed Protective Order as expeditiously as possible.
