5/08/97 COMMENT RESOLUTION In their vote sheets, Chairman Jackson and Commissioners Rogers, Dicus, Diaz, and McGaffigan approved the staff's recommendation, although Commissioners Dicus and Diaz would have preferred to make the rule a matter of strict Agreement State compatibility (compatibility category 1).

Moreover, Commissioner McGaffigan would have preferred that the draft final rule not exclude uranium and thorium mills and in -situ leach facilities.

All Commissioners provided some additional comments.

Subsequently, i

the comments of the Commission were incorporated into the guidance to staff as reflected in the SRM issued on May 21, 1997.
