Gentlemen:

This is with reference to or Notice of Violation and Proposed Imposition of

Civil Penalty (Notice) dated September 27, 1984.

In your letters dated

October 23, December 3, and 13, 1984 you requested suspension of the civil

penalty proceeding pending completion of judicial review of the Department of

Labor's Decision and Final Order dated June 14, 1984 which was the basis for

the Notice.

In my letter dated January 10, 1985, I agreed to suspend the

civil penalty proceeding pending resolution of your appeal to the United

States Court of Appeals of the above mentioned Department of Labor decision.

On December 26, 1985, the United States Court of Appeals for the Tenth Circuit

issued a decision in your appeal. Accordingly, you should now respond to the

Notice. Your time to answer the September 27, 1984 Notice expires thirty days

from the date of this letter.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter will be placed

in the NRC Public Document Room.
