Box 171 Apollo, Pennsylvania 15613 Gentlemen Occasionally licensees quary the Nuclear Regulatory Commission regarding the options that may be available to them in response to illegal demands ibr special nuclear material based on kidnapping or the taking of hostages. Section 57 of the Atomic Energy Act of 1954, as amended, directly prohibits the delivery o f special nuclear material (SNH) to any other than a licensed person or persons (or certain exempted persons). Under Section 222 of the Act, any v tola-tion of Section 57 is a felony.
The criminal penalty in Section 222 would cover individuals employed by the Nuclear Regulatory Consission as wil as by any other Gcvernuent agency. Therefbre, the conmiission could not legally authorize the delivery of special nuclear material to an extortionist.
