Your letter dated January 27, 1986 requested that the Nuclear Regulatory Commission continue the suspension of the civil penalty proceeding initiated with issuance of a Notice of Violation and Proposed Imposition of Civil Penalty dated September 27, 1984.
The basis for your request is your petition for writ of certforari to the Supreme Court of the United States regarding your appeal in Kansas Gas and Electric Company, et al v. William E. Brock, et al. As requested, we will continue the suspension of the civil penalty proceeding pending completion of Supreme Court review of this matter.
Notwithstanding our decision to continue the suspension of the civil penalty proceeoir.g. you should address the essence of the issue in the Notice of Violation by describing those policies and practices of the Kansas Gas and Electric Company which you believe prevent such issues from occurring at the Wolf Creek Generating Station.
Your response should be submitted within thirty days from the date of this letter.
The response directed by this letter is not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511. In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the Public Document Room.
