' REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE

. FOR CERTAIN FRAMATOME TECHNOLOGIES INFORMATION Dear Mr. Taylor. -

I- ' By letter dated April 22,1997, you submitted information to be discussed at a meeting with NRC staff on April 23,1997. By an affidavit of the same date, you requested that some of the

information be considered proprietary and withheld from public disclosure pursuant to'10 CFR -

,' 2.790. The information pertained to details of FCF fuel performance and design and also on the f

l status of certain topical reports either previously submitted or planned to be submitted before the y end of this fiscal year.

You stated that the information has been held in confidence by FCF and should be considered i

exempt from mandatory public disclosure. In the enclosed affidavit, you indicated that this information is considered proprietary for the following reasons:

  • ~

(a)- The information reveals data or material concoming FTl research or development plans or programs of present or potential competitive advantage to FTI.

4 (b). The use of the information by a competitor would decrease his expenditures, in time or resources, in designing, producing or marketing a similar product, i (c) : The information consists of test data or similar data concoming a process, method, j component, the application of which results in a competitive advantage to FTI. i We have reviewed the information in accordance with the requirements of 10 CFR 2.790 and, on l the basis of statements by FTI, have determined that the information sought to be withheld does  !

contain trade secrets or proprietary commercial information.

l Therefore, we have determined that the information identified as proprietary in the above document, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section -

103(b) of the Atomic Energy Act of 1954, as amended. Also, the information not identified as proprietary will be placed in the NRC public document room.

! Withholding from public inspection shall not affect the right, if any, of persons properly and -:

- directly concemed to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the  ?

consultants have signed the appropriate agreements for handling proprietary information, g[0)
