Dear Mr. Lochbaum:
I am responding to your letter of June 2,1997, in which you recommended that the U.S. Nuclear Regulatory Commission (NRC) reevaluate its guidance on when a nonconforming condition warrants a reactor shutdown.
As you know, on May 7,1997, the NRC published for public comment (62 FR 24998 May 7,1997) NUREG-1606, " Proposed Regulatory Guidance Related to Implementation of 10 CFR 50.59."
This proposed regulatory guidance reaffirms existing regulatory practice in many areas, clarifies the NRC's expectations and positions in areas in which the industry practice or position differs from the NRC's expectations for implementation of 10 CFR 50.59, and establishes guidance in areas in which previous guidance did not exist.
As part of its effort to examine the 10 CFR 50.59 process, the staff will be considering improvements in the existing guidance for determining when licensee actions need to be completed when an unreviewed safety question exists. The staff will consider the issues you have raised as part of the comment review process for the proposed guidance.
