Dear Congressman Broyhill:

Your December 11, 1984 letter requested the views of Mr. James Tourtellotte on NRC licensing and backfitting practices in general and with regard to the Duquesne Light Company in particular. Your letter also asked for an update on the status of the Comission's efforts to' address the problem of last minute allegations.

I am enclosing the report Mr. Tourtellotte has prepared at your request (Enclosure 1) as well as the coments provided by the Executive Director ,

for Operations on Mr. Tourtellotte's report (Enclosure 2). The Comission has not yet had an opportunity to review either Mr. Tourtellotte's report or the staff coments and may wish to provide you with coments separately.

that the Com.ission also has asked the You Office may be interested of Inspector and in knowing (OIA) to review the NRC's past and current Auditor backfitting practices, including the application of those practices to Duquesne Light Company. Both Mr. Tourtellotte's report and the ED0's coments have been provided to 0IA for consideration in its review.

The Comission has taken two recent actions to address the problem of last minute allegations. Most recently, the Comission approved on February 15, 1985 a policy statement on the handling of last minute allegations (Enclosure 3). That policy statement has been forwarded to the Federal Register for publication.

On December 27, 1984, the Comission published proposed rules in the Federal Register. The proposed rules are designed to, among other things, specify further the documentary bases for moticas to reopen records in fortnal licensing hearings (Enclosure 4). Coments on this proposed rulemaking have been received and are being evaluated.
