This is in partial response to your letter dated November 15, 1985,-in which you requested, pursuant to the Freedom of Information Act, three categories of documents related to the Backfit Rule published in the Federal Register on September 20, 1985.
The records listed on the enclosed Appendix A are already available in the NRC Public Document Room (PDR), 1717 H Street, NW, Washington, DC. There is no charge for inspecting records maintained in the PDR. We are enclosing a copy of a notice that provides charges and procedures for obtaining copies of records from the PDR.
The documents listed on the enclosed Appendix B are being placed in the PDR.
You may obtain access to these records by presenting a copy of this letter to the PDR staff or by requesting PDR folder F01A-85-759 in your name.

The documents listed on the enclosed Appendix C are being withheld from public l
disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and l
10 CFR 9.5(a)(5) of the Commission's regulations. These documents are drafts containing advice, opinions, and recommendations. Release of this type of information would tend to inhibit the frank and candid exchange of information in future deliberations and thus would not be in the public interest. There are no reasonably segregable factual portions because release of the facts j
would permit an indirect inquiry into the predecisional process of the agency.
l Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been l
determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. John Hoyle, Assistant Secretary of the Commission.
