Dear Mr. Barron:

i By letter dated February 20,-1997, as supplemented by letter dated April 1, 1997, Duke Power. Company (DPC) submitted the following revisions to the McGuire Emergency Plan Implementing Procedures (EPIP): RP/0/A/5700/06 dated

February 20, 1997, and RP Manual Section 18.2 dated February 12, 1997. These

! -EPIPs have been identified by DPC as containing privacy information (i.e.,

home phone numbers) and appropriately marked as such.

We have reviewed DPC's submittal based on the requirements and criteria of l 10 CFR 2.790 of the Commission's regulations, and have determined that the  !

submitted information contains privacy information. Therefore, the privacy information so identified by DPC.will be withheld from public disclosure pursuant to 10 CFR 2.790(a)(6) and Section 103(b) of-the Atomic Energy Act of 1954, as amended.

Withholding information from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of the information to our consultants ,

working in this area. We will, of course, ensure-that the consultants have l signed the appropriate agreements for handling proprietary information.  !

If the basis for withholding this information from public-inspection should l change in the future, such that the information could then be made available j for public inspection, you should promptly notify the NRC. You should also '

understand that the NRC may have cause to review:this determination in the .

future,- such-as, if the scope of a Freedom of Information Act request includes your information. If the NRC determines that the information should be made
