Items not specifically required but of a general informational value vill be given in the General Information section. Each section following the general information corresponds to the required section as listed in Section 6.6.la of the AFRRI Technical specifications.

SECTION I. CHANGES TO THE DESIGN, CHARACTERISTICS, AND PROCEDURES:

RESULTS OF SURVEILLANCE TESTING.

A. There were no changes to the design or characteristics as given in the facility SAR during this reporting period. New Facility Operating Procedures were reviewed and placed in effect (6 Nov). A copy is enclosed as attachment 1. A revised Physical Security Plan was submitted (30 April) and approved (28 June). A renewal of the interagency agreement with DOE to retain possession of the reactor TRIGA fuel until 30 Sep 1989 was completed, enclosed as attachment 2.

B. All surveillance items were accomplished on time.

Halfunctions discovered are included in Section IV.

Unscheduled maintenance is listed in Section IV.

SECTION IV. SAFETY CORRECTIVE MAINTENANCE The following are malfunctions that occurred to reactor equipment during this reporting period. The reason for the corrective action

i taken, in all cases, was to return the failed unit to its proper operational status, l

23 Jan 1985 During the daily shutdown it was noted that the ,

purification pump had tripped. The problem was found i to be a broken wire in the junction box attached to the pump. The wire was repaired; the pump tested and returned to service.

21 May 1985 During a run the reg rod would not withdraw past

' 15.7 percent. The barrel and gears were cleaned, i and the unit was returned to service.

13 June 1985 During a run the reg drive began sticking at several locations, both in traveling up and down. The drive was removed for maintenance.

19 June 1985 The reg rod drive was reinstalled after replacing several gears. The drive system was cleaned and lubricated. The rod was chocked out and found to be functioning properly.

19 Aug 1985 The automatic mode failed and cycled down during a lovlevel run. The operator switched to manual and completed the run. A check of the system found nothing amiss; system was considered operational.

11 Oct 1985 Auto mode malfunctioned during a K excess measurement in that it consistently ran the reg drive'down. Relay E-3 was replaced; the auto mode was tested and found to be operational.

18 Dec 1985 The transient rod drive air. hose was found to be leaking air. Upon replacing the hose the screw assembly mechanical stop was found to be rubbing against the barrel. The screws were found to be loose; when tightened one sheared off. Both were replaced; I the drive was tested and found to_be operational.

SECTION V. FACILITY CHANGES There were no changes to the reactor facility this period; however, the military construction project aimed at upgrading

! AFRRI's heating and air conditioning as well as power distribution was begun. It is anticipated that the beginning of the reactor portion vill begin in calendar year 1986.

l l SECTION VI. SUNNARY OF SAFETY EVALUATION CHANGES NOT SUBNITTED TO NRC PURSUANT TO 10 CFR 50.59 There were no changes, new tests, or experiments during this period.

SECTION VII.

SUMMARY

OF RADIOACTIVE EFFLUENTS RELEASED A. Liquid vaste - The estimated average release on a quarterly basis is less than 25% of the allowabic amounts under 10 CFR 20 app B.

E. Gaseous vaste - There were no particulate discharges in CY 1985. The total argon-41 discharged in CY 1985 was 22.26 Ci.

C. Solid Waste -

All solid material was transferred to the AFRRI byproduct license; none was disposed of under R-84.

SECTION VIII. ENVIRONMENTAL RADIOLOGICAL SURVEYS A. The environmental sampling of soil, water, and plant growth had radionuclides levels that were not demonstrably above the normal range. The radionuclides that were found were those normally expected from natural backround and from long-term fallout.

B. The environmental monitoring (dosimetry) program had the following results for CY 1985:

1. The average backround was determined to be 90.76

+/- 8.16 mrem.

2. The average reading from near plant stations above background was determined to be -1.43

+/- 1.04 mrem.

3. The single highest station reading was 7.3

+/- 19.75 mrem above backround.

4. The above results are expressed at a 95%

l confidence level.

C. The in-plant surveys, including analysis of effluent filters, showed no measurable activity (except in VII above) in all areas outside the normal restricted-access areas.

D. There were no special environmental studies conducted this year.

SECTION IX. EXPOSURES GREATER THAN 25% OF 10 CFR 20 LIMITS There were no exposures to staff or visitors greater than 25% of 10 CFR 20 limits.

PROCEDURE I ENDUCT OF EXPERDfDTTS General:

1. All experimnts will be observed during irradiation with the exception of CET experiments or those in which no movement is pos-sible. 'lte closed-circuit televisions (OCIV's) in the exposum rooms and over the reactor pool can be used to meet this requim ment.

( 2. All experiments will be set up so as to preclude movement unless the experiment apparatus is designed for movement (such as rotators,'

etc.).

3. AIARA will be practiced during all experiments.

General: ALARA principles will be practiced as much as possible during CET operations.

1. CET Tnaartion into the core:
a. Ensure a reactor operator is monitoring the Isactor emele.
b. Ensure a Ioactor staff mamhar is present in the Isactor room.
c. Estahlich mammications between the Isactor rom and the control rom.
d. 1 Dst fuel ham 11ng tool for operability.
e. Iower the fuel ham 11ng tool into the ooze and attach to alsunant F28. Notify operator on the console that you are prepared to lift fuel alsunant. When at*newledged, lift fuel element fra the core.
f. Transfer elant to a storage rack location and secuze fuel-ham 11ng tool cable.
g. Loosen CET bracket screws and Ismove CET bracket.

i h. While the CET is held down, cut cable ties fra around the CET.

1. Lift CEI fr a the storage rack location and transfer to the reactor mrriage, ensuring that the CET Isuwtins as low in the water as pnnaible.
j. Notify the mnela operator that are prepazed to lower the CEI into the core: when at*nnwledged, lower the CEI into the ooze, ensur-ing that it is g cyfu=ly seated in the lower grid plate.
k. With a downward gesum on the CET to keep it eested, secure the CET brookst with the two screws.
1. Ensure appropriate entries are made in the operations logbook and the fuel book.
2. Irradiation:
a. rnaan the rabbit (s) using alcohol and water.

( d. Bring the reactor up to the appropriate power.

time in the vicimity of the carriage. Do NOT lower the rabbit with the extractor tool while at power.

3. Rabbit Retrievals:
a. Ensure that an operator and a Radiation Safety Department (SAF) monitor are pN=mut, in the reactor room and that they a m wearing wrist dosimetry. If the CET is in the ooze, a Isactor operator must monitor the mnanla during the retrieval.
b. Test the rabbit extractor ("fic:hing pole") for operability.
c. Insert the extractor head manhaniam into the CET and Isel out cable until you zesch the low and indicator painted on the cable.
d. Drop the extractor head firmly on the rabbit.
e. Ensure the SAF monitor has a teletector positioned near the CET top to monitor the rabbit.
f. If the CET is in the oore, notify the Isactor operator that the rabbit is being pulled and continue vben acknowledged.
g. Reel in the cable at a rate memannurate with radiation levels; lower the rabbit back into the CET if the rabbit is emoessively hot.
h. Stop vben upper and indicator is vinihla on the nnhia; have SAF take an accurate radiation reariing.
1. If radiation levels are acceptable, swing rabbit away frcui car-riage and have another. individual grab it with a ham 11nd tool.
j. Ralamaa extractor head and detach rabbit from head.

k. Unless working with the rabbit. cr radiation levels are very low

( 1 mR/hr), store rabbit or irradiated material in a lead pig or storage cask.

4. CET Removal from CoIe:

c. Notify console operator that you are prepared to Innove the CET.

g. Remove the fuel alamant frczn the storage rack and transfer to ooze.

h. Ensure the alsanant is pwfuly seated in the lower grid plate by listening for the " double olir*a".

GENERAL: The extractor system will be tested for operability prior to the

( initial experiment for the day.

SPECIFIC:

1. Asaambly of the extractor system-
a. Tnaida the exposum rom:

, (1) Move the incida receiver section into position in front of the core; plana lead bricks on the tube supports and screw them to the floor.

(2) While hniding the ayyugiate connecting tube in position, tie j the strings in the tube to the two ends oming out of the ex-posure ro m wall and to the two enas in the receiver section.

(3) Align the ends of the tubes and alida the clamps over each joint.

(4) Place the alignment tools into the appropriate holes to check the tube alignment; tighten down the clamps.

(5) 7 e3; the electrical mhla to the limit switch.

(6) Remove the alignment tools.

b. Outside the exposure roam:

( (1) Remove tube plug.

(2) Move the moeiver section close to the tube projecting from the wall.

(3) Tie the string from the end of the samt11 tube to the end of the wire cable.

(4) Pull the string in the large tube slowly wtile having the same-one inmida the room guide the string.

(5) When the mhla is all the way through both tubes, thread the cable through the moeiver tube while moving the moeiver table into final position against the wall (if namaamstn, add an ad-ditional length of mhla to the take up mel).

(6) While smanna else is pushing the table towszti the wall, insert two samws into the hnlaa on the securing bracket (beneath the table).

(7) Position and tighten clamp over the joint; position carrier in i

tube and nnnnaM; cable to each end; remove the tape on the take

(8) Pull back on the on the drive motor assembly until them is no alar

a. On the motor control, initially set controls as follcres:

(2) Tozque control: "CFF" (3) In/out switch: " BRAKE".

(4) Speed control: "O%".

b. Plug in AC outlet; switch the power switch to "CN".
c. Switch in/out switch to appropriate position.
d. Slowly increase speed to an app e p-iate level; as the a rriage ap-proaches its full in/out position, decmase the speed slowly to 3
e. Turn the in/out switch to " BRAKE"
f. During power operations, ensure that the following requimments are met: '

(1) The pmp ama is sealed off.  !

(2) A Radiation Safety Department (SAF) monitor is pmeent. l 1

l TAB D: PNEUMATIC IBANSFER SYSTEM (PTS)

General:

l

1. AIARA principles will be practiced as much as possible during l

PTS operations.

2. All PTS operations will be directly. supervised by a reactor operator present in the Hot Iab.

Specific:

1. PIS Setup:
a. Position oom at 833 (imida mgion III).
b. Ensum ev=mimtions is estahlinhad between the hot lab and the control room.
c. Inspect rabbits to be used in the PIS for cracks or other damage.
d. Aluminum rabbits must be diverted to the Hot Cell and them-fom may only be used on the "A" system.
e. If the anticipated radiation level of any mturned rabbit is gmater than 1.0 R/hr at 1 meter, take the following pmosutions:

! (1) Use the remote control unit, unless experiment requim-ments dictate otheIvise.

(2) Place a radiation survey meter next to the receiver /aarrior station so that it can be monitored from the mmote control unit.

(3) The rabbit will be irradiated in the "A" system and then diverted to the Hot Cell or returned to the irradiation loca-tion.

2. Manual Operations:
a. Ensure all switches on both the local and remote control units are in the "CFF" position: place the local /zemote switch in the desin d position.

b. Place blower switch in the "ON" position.
c. Insert key into local control unit: turn key to "W " position.
d. Ensure tubes are e ~rpty. '
e. Set acie switch (man ~off ' auto) to " MAN" position. Blower will i start.
f. Set in/out switch to the " cur" position and the tube on/off switches to "W "; allow the system to run for a short time.
g. Set tube on/off switches to "OE7" and turn in/out switch to "IN".
h. Iced samples into tubes.
1. Cbeck ocumunications with mactor operator at the reactor console.

J. When the reactor is at the designated power level, set the tube on/off switches to "CN" one at a time, to send rabbits into the irradiation location.

k. Begin stopwatet or timer. ,
1. Turn tube on/off switches to "CFF" and turn in/out switch to "OOT".
m. Ensure a Radiation Safety Department (SAF) monitor is present during retrievals
n. Set on/off switch to "W" one at a time; rabbits v'11 mturn to serrkr/ receiver station.
o. Set all switches to "OFF", and mmove key frcan control unit.
3. Autcznatic Mode:
a. Canplete steps 2a-d above. s, ,
b. Set mode switch to "AUIO" position. Blower will start.
c. Complete steps 2f-i above.
d. Set timer (O to 5 minutes) by turning the red and blanir arrows to the desimd irradiation time.
e. When the reactor is at the chaired power level, briefly push the timer push botton and Islease. 'Ibe rabbits wi.11 leave the zeoeiver/

smvkr station and will autcaintically return at the end of the preset irradiation period. T.te timer will automatically reset.

f. Turn all switches to "TF" and Iemove key frcan control unit.

a. Diversion of samples to the Hot Cell may only be made using the "A" system

Specific:

1. Pmventative Maintananna procedums for each item of the reactor systems is provided in the maintananno logbook.
2. Annual shutdown yInwmN am given in the Annual Shutdown N 11at which each year is m vised by the Reactor Operations Supervisor (R06) and appuvui by the Reactor Fanility Director.
3. Malfunctions are annotated in the Nalfunction Iogbook.

Each entry is made by the operator who die wm ul the defi-ciency. When oormctive actions have been made azzi annotated in the malfunction logbook, the RFD or ROS shall review and initial the entry.

PROCEDURE VII REACICR CIRE IDADDG AND UNIIMDDG General: Lewi4tg and uninading of the mactor core shall be under the super-vision of the Reactor Fanility Dizector or the Reactor Operations Supervisor.

These procedures am supermiari in the following situations: during CET Oper-ations (see Procedure I-Tab B) and during an m al shutdown maintananna (see the

current Annual Shutdown M1iat).

Specific:

1. Setup
a. Ensure at least one nuclear instrumentation nhannal is operational.
b. Ensure an operator monitors the Isactor console during the all fuel movements.
c. Check new fuel alamants prior to insertion into the core: this includes claaning, visual inspection, and length and bow measumments.
d. If irradiated fuel alamants are to be Iemoved imahialriari from the pool, a Special Work Permit (SWP) will be obtained fr a the Radiation Safety Department (SAF): fuel alamants with a power history (greater than 1 KW) in the pmvious two weeks ahm11 not be removed fra the Isactor pool.

(heromafter called the " Agency"), an executive department or independent establishment of the Government of the United States of Amenca or a bureau or office thereof; WHEREAS, the parties hereto desire to establish the terms and conditions applicable to the distribution of special nuclear material to the Agency, pursuant to the Atomic Energy Act of 1954, as amended, whether ordered and received directly from a DOE facility or transferred from a lessee of DOE; NOW, THEREFORE, the parties hereto do mutually agree as follows:

ARTICLE 1-DEFINITIONS As used in this Agreement:

4 i a. The term "Act" means the Atomic Energy Act of 1954, as amended.

i b. The term " base charge" means the dollar amount per unit of normal or depleted uranium or special nuclear material in standard form and specification in effect as of the time any particular transaction under this Agreement takes place, as set forth in schedules published by DOE in the Federal Register

] from time to time.

c. The term " blending" means the altering.of the isotopic composition of a quantity of an element by j means other than through the irradiation of a mate ialin a nuclear reactor.
d. The term " DOE" means the Department of Energy, exercising the authority and performing the

,, functions of the Secretary, the statutory head of. that agency, or any duly authorised representative i

thereof, including the Contracting Officer except for the purpose of deciding an appeal under the article entitled " Disputes."

e. The term " DOE's facility" means a laboratory, plant, office, or other establishment operated by or on I

behalf of DOE.

[ f. The term " DOE's established specifications" means the spelfications for purity and other physical or chemical properties of normal or depleted uranium or special nuclear material, as pubbshed by DOE in the Federal Register from time to time.

g. 'llie terms " consumed" or " consumption" means the destruction, burnup, loss or disposition of
matanal in such manner that it cannot be economically recovered for further use, material unaccounted i ibr, or changes in the composition of material due to blendmg of different assays of material or other
alteration of the isotopic ratio resulting in the reduction in value of such material.
h. The term " depleted uranium" means uranium having a weight fraction U-235 of less than 0.00711.

t i. The term " established DOE pricing policy" means any applicable price or charge in effect at the time

any paracular transaction under this Agreement takes place (i) published by DOE in the Federal Register, or (ii)in the absence of such published figure, determined in accordance with DOE's Pricing Policies. DOE's published prices and charges, as well as its P; icing Policies, may be amended from time to time.

J. The term " lessee" means a person who is a party to a Special Nuclear Material Lease Agreement with l

DOE. For the purposes of this Agreement, the term " lessee" also includes another Government Agency which has executed a Special Nuclear hterial Interagency Agreement with DOE.

k. The term " normal uranium" means uranium having 0.00711 weight fraction U.235.

I. The term " persons acting on behalf of DOE" means employees and contractors of DOE. and employees of such contractors, who implement or participate in the implementing of this Agreement pursuant to their employment or their contracts with DOE.

m. The term " source material" rnamne (1) uranium, thorium, or any other material which is deternuned by DOE pursuant to the provisions of Section 61 of the Act to be source material; or (2) ores containing one or more of the foregemg materials, in such concentration as DOE may by regulation determine from time to time.
n. The term "special nuclear material" means (1) uranium.233, uranium enriched in the isotope 233 or in l

the isotope 235, and any other material which DOE, pursuant to the provisons of Section 51 of the Act, determines to be special nuclear material, but does not include source material; or (2) any material artificially enriched by any of the foregoing, but does not include source material.

o. The term " standard form" means the chemical form of normal or depleted uranium or special nuclear material, as published by DOE in the Federal Register from time to time.
p. The term "value" means the dollar amount determined by multiplying the applicable ' base charge by the number of units, or fractions thereof, of normal or depleted uranium or special nuclear material involved, whether or not such material is in standard form or meets DOE's establ.shed specifications; provided, however, where uranium ennched in the' isotope U.235 subject to this Agreement has its isotopic ratio altered by the generation of uranium isotopes U.232 and U.233 duringirradiation of the material in a nuclear reactor, the term "value" for the purpose of determinmg provisional payments for consumption of such material, means the dollar amount determined by multiplying the number of grams of U.235 by the base charge per gram of U.233 calculated from subparagraph 3(a)of the Federal -

Register Notice entitled " Plutonium and Uranium Enriched in U.233; Guaranteed Purchase Prices,"30 F.R. 3886, March 25,1%5, as the same may be amended from time to time.

ARTICLE 2-SCOPE a.

Unless otherwise provided herein, or in a written agreement between DOE and Agency, the terms and 5

conditions contained herein shall' apply to special nuclear material and related services furnished to Agency by DOE on and after the date of enscution of this Agreement, whether ordered and received directly from a DOE facility or obtained from another lessee of DOE. Nothing herein shall be deemed i

to prevent Agency from shipping material covered by this Agreement to any person duly authonaed by DOE to process and use such material. Agency may be rehoved of its obligations under this Agreement for such maternal only in accordance with the terms of this Agreement. Material received by Agency hom any sousoe shall be subject to the provisions of this Agreement only if such materialis furmshed parsuant to an onder accepted by DOE as provided in paragraphs b. and c. below,

b. Agency shall order material pursuant to this Agreement thsough the execution and submisson of a special nuclear material order form prescribed by DOE.
c. Acceptance of Agency's order for material by or on behalf of DOE shall constitute DOE's commitment to furnish the material specified in such order subject to the terms of this Agreement. When Agency orders raaterial which is to be obtained from a leesse, this Agreement shall not be applicable to such material until such lessee and DOE have agreed to the transfer of such material to Agency.
d. Nothing herein shall be deemed to obligate Agency to order material or to obligate DOE to furnish material to Agency, or to provide services for Agency with respect to material.

! ARTICLE 3-TERM OF AGREEMENT, TERMINATION AND CANCELLATION

} a. Except as otherwise provided herein, the Agency shall have the right to possess and use the material

covered by this Agreement until SeDtember 30. 1989
provided that material subject to this Agreement shall not, unless otherwise authorized in writing by DOE be used in the course of actmties

{ under a license issued pursuant to section 103 or 104b. of the Act.

b. Agency may cancel any order for material under this Agreement by notice in writing to DOE at any

)' time prior to delivery of the material; provided, Agency shall reimburse DOE for the costs incurred by DOE in connection with such order, as determined in accordance with established DOE pricing policy in effect at the time such costs are incurred.

c. DOE may termmate or suspend in whole or in part this Agreement at no cost to DOE at any time, by 4

written notice to Agency in the event that (1) the right of Agency to possess material subject to this Ayeoment expres or is suspended or terminated by any authority having power to take such action, or (2) Agency shall fail to perform its obligations hereunder and shall fail to take corrective action within

30 days of the date of the written notice of such failure to perform as provided above, unless such failure arises out of causes beyond the control and without the fault or negligence of Agency.

ARTICLE 4-MATERIAL TO BE FURNISHED BY DOE

a. Except as otherwise agreed to in writing by DOE and Agency, special nuclear material subject to this Agreement shall be furmshed to Agency in standard form in accordance with DOE's established specifications.
b. Agency sha!! pay DOE's semce charges,if any, for withdrawal and packagmg, and for any other special 4 service rendered pursuant to Agency's order. Unless such charge or charges are agreed to in the order executed by Agency ~and DOE for material, Agency shall pay DOE its charges for the services rendered

]; pursuant to Agency's order as determmed in accordance with established DOE's pncing policy in effect at the time such services are rendered. Agency shall also pay the value of material consumed in the rendering of such special services.

c. If the material delivered by DOE pursuant to an order executed by Agency and DOE does not conform j to DOE's established specifications (or to the specifications set forth in an order executed by Agency j and DOE), the responsibility and liability of DOE and persons acting on behalf of DOE shall be limited 1

] solely to correcting such discrepancies by delivery of material which does conform to the applicable a

specifications. Neither DOE nor persons acting on its behalf shall have any responsibility or liability for +

replacing or furnishing material which Agency obtains directly from a lessee of DOE. DOE will pay to

, the carner the transportation charges for retuming any material obtained directly from DOE which does j not conform to applicable specifications, as well as the transportation charges for shipping conforming replacement material. No service charges will be made with respect to such replacement material, and

l d. It is recopused that material furnished under this Agreement as enriched uranium (U.235) may be j --i in such manner as to reduce the isotopic ratio thereof to the extent that the leased material is

} no longer special nuclear material as defined in this Agreement. Except as provided in this paragraph, or j

in paragraph e. below, the resulting normal or depleted uranium will be and roman subject to the i

grovisions of thh Agreement as if the material were special nuclear material. Agency's obligations for f consumption of such material shall be computed using the value of the normal or depleted uranium. lf, i in lieu of returning such material directly to a DOE facility as provided in this Agreement, Agency -

l desires to transfer such material to another person and terminate its obligations with respect thereto.

DOE may, at its option, require Agency to pay the value of such material and transfer full custody and responsibility of such material to Agency.

(1) DOE, upon delivery to Agency of U 233, or uranium enriched in the isotope 233 subject to this Agreement, may direct that such U-233 or uranium enriched in the isotope 233 not be blended with other uranium.

(2)!n the case of blendmg of normal, depleted or enriched uranium subject to this Agreement with pnvately owned uranium other than U-233 or uranium enriched in the isotope 233:

(A)If, within one-hundred twenty (120) days from the date of completion of the blending, DOE receives the written agreement of all such parties thereto, and 1.The assay (weight percent U-235) of the Mended product is higher than that of the DOE-furmshed material used in blending, (a) DOE shall debit Agency's account with the value of such portion of Agency's share of the blended product as does not exceed the value of DOE furnished material used in the Wending;(b) full custody to and responsibility for the blended product so debited to Agency's account shall be deemed to be transferred to DOE; and (c) Agency shall pay to DOE the amount, if any, by which the value of the credited material exceeds the value of the debited material, or 2.The assay (weight percent U-235) of the blended product'is lower than that of the DOE fumished material used in the blend, (a) DOE shall debit Agency's account with the value of such portion of Agency's share of the blended product as has a feed component which does not exceed the feed component (assuming uranium having an assay of 0.711 weight percent U-235 was used as a feed material) of Agency's DOE-furnished material used in the blending and credit Agency's account with the value of Agency's DOE furnished material used in the blending; (b) full custody to and responsibility for the blended product so debited to Agency's account shall be deemed to have been transferred to DOE; and (c)

Agency shall pay to DOE the amount, if any, by which the value of the credited material exceeds the value of the debited material.

(B)If such written agreement has not been so received by DOE, unless otherwise agreed to in writing by DOE, lessees and owners of privately owned uranium,

1. Agency shall be deemed to have acquired the material on its Agency account that was used in the blending and shall pay DOE for the value of this matenal so acquired, and
2. Full custody to and responsibility for such material shall be deemed to have transferred from DOE to Agency upon payment to DOE of the amount due.

(3)ln the case of blending of uranium subject to this Agreement with privately owned U 233 or l uranium enriched in the isotope 233, Agency agrees either (A) to secure DOE's written agreement in advance as to the terms and conditions under which such material may be bier and or (B) to accept as conclusive and binding DOE's determination in writing as to the consetuences of any such blending including the disposition of any blended product and amounts due DOE and Agency.

(4) As used in subparagraph e. (2) the term "value" refers to value as of the date of completion of the blending. The feed ecmponents speci5ed in subparagraph e. (2) (A) 2. shall be derived from the established DOE standard table of enriching services published from time to time by DOE in the Federal Register as in effect as of the date of completion of blending.

(5)lt is hereby agreed that Agency shall be responsible for handhng any claims of third parties on account of rights alleged in or in connection with the source material or special nuclear material used in blending.

(1) Agency shall maintain and make available to DOE for examination, upon reasonable notice, complete and adequate records pertaming to its receipt, possession, use, loca. tion, movement, and physical inventories of material subject to this Agreement. Such records shall fully reflect physical measurements, consumption, actual inventories, and the transactions relating thereto. Agency will l

5 submit such transfer documents and reports reflecting quantities of material received, physically 3 present, consumed and transferred, with respect to material subject to this Agreement as DOE may prescribe. Agency mil make at least one physical inventory of material subject to this Agreement and in the custody of Agency during 12 months' period of the Agreement and willinsure that such inventories are also made of material subject to this Agreement but in the custody of others.

(2) Agency shan! afford to DOE, at all reasonable times, opportunity to inspect the material subject to this Agreement and the premises and facilities where such materialis used or stored. Agency shall permit DOE to perfcrm such audit tests and inventory tests (which may include the taking of a i '

reasonabh number of samples for physical or chemical analyses but which does not include sampling and de tructive testing of fabricated articles except as agreed to by Agency) as DOE deems necessary for verification of the accuracy of any reports submitted by Agency to DOE. DOE agrees to perform any inventory tests with respect to material subject to this Agreement so as to marumise interference to Agency's psocesarft, dehvery schedules, and third. party commitments regardmg the materiaq Agency agrees that no charges for costs or value of any material samples, or for services or

. equipment, should sadt be furnished by Agency, provided in connection with the performance of

' audit totts and inantory tests, shall be made agamst DOE; however, DOE will allow full credit in

Agency's account'w.th DOE for the value of the material included in the samples and DOE will l make no charge against Ageacy for reconversion of the material samples to standard form. In the event Agency should ship' material subject to this Agreement to any other person, or cause such j shipment of such material, Agency shall assure that the rights and privileges granted to DOE under

] this paragraph shall not be affect:4 by such shipment.

I j ARTICLE 5-RETURN OF MATERIAL TO DOE; SPECIAL CHARGES FOR DOE SERVICES

) a. Agency shall retum all material subject to this agreement which has not been consumed upon the

] expiration or earher termmation of this Agreement, provided, however, that Agency shall have the right to return any such material at any time prior to such date.

b. Except as otherwise provided herein, material returned by Agency will be returned directly to DOE in ,

j the standard form and in accordance with DOE's established specifications for return of material in effect as of the date the materialis returned. .

c. Material subject to this Agreement transferred to a lessee of DOE, regardiass of the form or specification of such material, shall be deemed to have been returned to DOE if such leue , DOE,, and Agency have executed an order covering the material so transferred.

i' d. DOE may at its sole discretion accept material in a form or specification other than as provided in b.

above. In such cases, unless DOE shall determme that acceptance of the materialin its existing form ir 4 in the best interests of the Government, Agency shall pay a service charge for processing such returned

material to as to enable it to meet the standard form and to satisfy DOE's established specifi
ations in effect at the time the material is returned. Such charge shall include DOE's charge for procesang, as y determined in accordance with the estabhshed DOE pricing pohey in effect at the time the materialis 4

wurned and an amount as determmed by DOE, for the value of the material consumed during such procesang. '

j e. ' Material subject to this Agreement returned directly to DOE in the form of uranium hexafluoride shall l be shipped only in containers of appropnate sias as specified by DOE. The quantity of such material I sklpoed in a container shall not be less than DOEetablished minimum loadmg for the type of container used. s

, f. All material retumed directly to DOE shall be delivered by Agency to DOE facility or location specified j by DOE, f.o.b. comrnercial conveyance at such facility or location. Unless waived by DOE, Agency shall give DOE at least fifteen (15) days' written notice of intent to return material directly to DOE. DOE i

will notify Agency promptly after receipt of Agency's notice of intent to return material as to the DOE

! facility or location designated for return of the material. Agency, at the time of shipment of material, j shall notify the DOE facility or other location to which shipment is made of the date and method of 1 shipment, and expected date of arrival.

ARTICLE 6-PAYMENT FOR MATERIAL CONSUMED i

a. Except as otherwise provided herein, Agency shall be responsible for and shall reimburse DOE for any consumption of material, whether or not such consumption is due to the fault or neghgence of Agency or any other cause occurnag from the time of dehvery of such material to Agency and until such material has been returned to DOE as pronded harem.
b. Agency shall make reports to DOE, on forms prescribed by DOE, to accurately reflect all consumption of material as then known to Agency. In reportug material as consumed, Agency shall make reasonable effort to accurately fix the time of such consumption on the basis of a specific occurrence or in accordance with procedures and methods of calculating consumption accepted by DOE.

j c. Except as otherwise pronded herein, the amount due DOE for material consumed shall be the value of

, such material computed in accordance with this Agreement as of the time of such consumption.

4 Agency may, and shall when required by DOE, pay on a provisonal basis for material consumed. Full

! custody to and responsibility for all consumed material, other than material the value of which has been j reduced by alteration of its isotopic ratio, shall be dee'med transferred from DOE to Agency upon f'mal i payment to DOE of the amount due.

ARTICLE 7-OTHER AUTHORITY -

Nothing in this Agreement shall be deemed to require Agency to pay the DOE's charges with respect to i materials or serness subject to this Agreement, or to observe other specific provisions of this Agreement,if DOE, in accordance with statutory authority or other authority available te it, determine that such charges, or other provisions are not applicable. j ARTICLE 8-ESTA8LISHMENT OF SPECIAL NUCLEAR MATERIAL ACCOUNT I a. DOE will establish a special nuclear material account for Agency to which will be debited, as provided herem, the amount or amounts equal to the value of the material subject to this Agreement. Such j account will be credited, as prended herein, with the amount or amounts equal to the value of the

! material returned or paid for in accordance with this Agreement. The value of material reflected in this account after credit for the value of material returned and for payments for material consumed shall represent the amount due to DOE for material not returned or paid for. In the event material paid for provisioneBy as having been consumed is later reestablished in Agency's account, said account shall be debited as of the date of refund (or appropriate setoff) of such payment to Agency as pronded in

parayaph c. of Article 10 hereof, with the amount or amounts equal to the value of such material at the I time of sech reestahhehment in Agency's account.
b. Emospt as otherwise provided in this Agreement, Agency's account will be debited for material

{ furnished as of the date material is delivered to Agency, prended that in the case of leased material transferred directly from a lessee of DOE, the debit will be made as of the effective date specified in the order executed by Agency, the lessee, and DOE for such material. Except as otherwise agreed to by l DOE, such effective date shall not precede the date of DOE's esecution of such order by more than 30

days and such date shall also be set forth in the applicable transfer document.

c. Agency's account will be credited for material returned to DOE or transferred to a lessee only when material is returned or transferred in accordance with Article 5. Except as otherwise provided in this Agreement, Agency's account will be credited for material returned directly to DOE as of the date the '

material is delivered to a location specified by DOE pursuant to this Agreement. Credit date specified in the order executed by the lessee, DOE, and Agency. Credit for material paid for will be made as of the date payment is received by DOE.

d. Whenever DOE changes any applicable base charge as provided in Article 9 below, the value of material recorded in Agency's account wdl be recorr.puted at the new bar charge ovided that tia value cf material consumed as of the effective date of such change shall not be recornputed. Subsequent to the effective date of the change in the applicable base charge, the new base charge wdl be used in determmmg the value of material consumed.
e. Agency will be promptly notified of the debits and c. edits made to its account as the result cf shipments, consumption, or transfers of material, and of any changes in the value of material in such account as the result of changes in the applicable base charges. Agency will promptly notify DOE of any disagreement with, or alleged discrepancies, or errors in such notices.

ARTICLE 9-CHANGES IN BASE CHARGES AND SPECIFICATIONS The base charges, standard form, and.7.;;Jications for material furnished pursuant to this Agreement are subject to change by DOE in accordance witt I e Act.

ARTICLE 10-PERFORMANCE OF DOE OSLIGATIONS-BILLING

a. DOE may fulfillits obligations under this Agreement through the operator of any of its facilities. No such operator is authorised to modify the terms of this Agreement, waive any requirement thereof, or settle any claim or dispute arising hereunder.
b. Billings for amounts due DOE under the Agreement will ordmanly be made:

' 1 (1) following the performance of any service, end (2) semiannually for consumption of material.

c. All billings and payments made on a provisional basis are subject to adjustment to recognize actual or calculated amounts, enrichment, isotopic content, and specifications of material involved. Whenever Agency has provisionally paid for material reported as having been consumed and such materialis later reestablished in Agency's account, DOE shall refund to Agency (or appropriately satoff against any amounts due DOE) the amount paid by Agency for such material. The adjustments provided for in this paragraph will not subject Agency or DOE to liability for interest.
d. AB bills rendered by or in behalf of DOE are due 30 days from the date of invoice.

ARTICLE 11-TIME OF DELIVERY DOE win make reasonable efforts to deliver material at the time or times stated in orders for material subject to this Agreement.

ARTICLE 12-DELIVERY-F.O.S. POINT

a. Material furnished directly from a DOE facility will be shipped f.o.b. Agency's vehicle or commercial conveyance at such DOE facility. Delivery of material or containers to Agency or its designee or to a f

8 carrier for the account of Agency or its designee shall be deemed delivery of such material or contamers to Agency for the purposes of this Agreement.

b. Unless Agency furnishes a prepared bill of lading, all shipments by DOE wdl be made collect on a commercial bdl of lading to be converted at destination.
c. When agency obtains matenal from a lessee of DOE pursuant to this Agreement DOE shall not be responsible for costs of packagmg, shipment, and handling.

ARTICLE 13-CONTAINERS AND EQUIPMENT

a. All shipments of material from DOE to Agency, and from Agency to DOE, wdl be made in Agency furnished containers; provided, however, that in the event DOE determines that the required containers are not reasonably available from commercial sources, DOE may furnish DOEowned containers if such are available. Any DOEowned containers to be used for shipment of material will be made available to Agency f.o.b. Agency's vehicle or commercial conveyance, at a DOE facility designated by DOE, unless otherwise agreed. Agency furnished containers and equipment shall be delivered to a DOE facility designated by DOE within a reasonable time specified by DOE prior to the scheduled delivery of materials to be shipped to Agency in such containers and equipment.

Agency furnished containers or equipment wdl be used by DOE only for the shipment of mate ial from DOE to Agency and for temporary storage of material shipped therein.

b. All containers and equipment, whether DOE. owned or Agency furnished, must meet DOE regulations, specifications, and practices as to safety, design criteria, cleanliness, and freedom from contamination in effect at the time furnished, utdized, or returned, of which DOE shall be the sole judge. In the event material is returned by Agency to DOE in non. DOE. owned containers and other materials are to be delivered to Agency, DOE shall utilize to the extent practicable such non DOEowned containers for shipments of materialif so desired by Agency. DOE will promptly return to Agency non DOE. owned containers and other equipment identified as " Returnable", but will not be responsible for any loss of or damage to such containers or equipment except as may result from its fault or negligence. Such return shiprnents by DOE wdl be made f.o.b. Agency's vehicle or commercial conveyance at DOE facility to which they were shipped.
c. Agency shall pay such rental charge, for such containe -s and equipment, as shall be established by DOE for general application to users of such DOE owned poperty. Agency wdl promptly return DOEowned containers and equipment to the DOE facility from which received, f.o.b. Agency's vehicle or commercial conveyance at the DOE facility. Agency will not be responsible for any loss or damage to DOE-owned containers or equipment, except as may result from the fault or negligence of Agency,its contractors, or agents. DOE-owned containers or equipment will be used only for shipment of material to and from DOE and for temporary storage of material shipped therein.
d. Whenever material or containers are shipped to DOE or DOEcwned containers are returned to DOE, and DOE elects to decontaminate the containers, railroad cars, trucks, or shipping vehicles or DOE's unloading area and machinery, because of the containers, or the material or the method of shipment failed to meet the health and safety standards prescribed by DOE or any Federal or State agencies havSig junsdaction over such matters, Agency shall pay DOE the full cost of such decontamination as determined by DOE in accordance with established DOE pricing policy. Any residual quantities of material in containers or equipment returned to DOE will be deemed to have been consumed by Agency, and Agency shall pay for such materialin accordance with this Agreement.

l ARTICLE 14-DETERMINATION OF MATERIAL QUANTITIES AND PROPERTIES I

a. DOE will furnish Agency a statement of the quantities and properties, including a statement of the weight of the material subject to this Agreement which is received by Agency directly from a DOE

facuity or returned directly to a DOE facility. The following provisions and procedures shall apply to the determination of the quantities and properties, including weight of the material:

1. DOE samples obtained at a DOE facility using DOE's procedures will be binding upon DOE and Agency unless DOE and Agency agree upon the use of other samples, procedures or sampling locations.
2. The weight of the material will be determined prior to delivery of Agency or acceptance of delivery 6

by DOE, as the case may be, at a DOE facility using DOE's procedures and facilities.The weight of the material determined by the result of such procedures shall be binding upon DOE and Agency, unless DOE and Agency agree upon other procedures or facilities.

b. Agency may, upon request to DOE, observe the weighing of the material and the taking of samples by DOE. The dates and places for the weighing and sampling will be established by DOE and communicated to Agency upon receipt of Agency's request.

ARTICLE 15-TRANSFER OF MATERI AL 1ransfer of material by Agency to a lessee with the approval of DOE as provided in this Agreement shall not have the effect of relieving Agency of any obligation hereunder, except as to return of or payment for material so transferred.

ARTICLE 16-OTHER CONTRACTS A*JD AGREEMENTS This Agreement contemplates the possbility of separate agreements between Agency and DOE with respect to materials which are wbject to this Agreement, which may provide for suspension; termination, or revision of matters hereunder; and for reimbursement of charges incurred pursuant to this Agreement. Except as provided in such agreements, Agency's obligations under this Agreement for material subject to this Agreement shall continue notwithstanding the existence of such separate agreement or agreements.
