Dear Mr. Carns:

Northeast Nuclear Energy Company's (NNECO's) April 20, 1994, letter notified the NRC, in part, that 14 containment isolation valves (CIVs) in containment penetrations X-204A, X-2048, X-204C, X-210A, and X-210B would be excluded from 10 CFR Part 50, Appendix J, Option A, Type C (local leakage rate) testing.

NNECO's justification for this position was, in part, that the lines terminate below the minimum water level in the suppression pool and, being water-sealed, do not constitute potential leakage pathways for containment atmosphere during -

a design basis accident. The letter also requested exemptions from the requirements of Appendix J for four containment penetrations. The exemption requests were withdrawn in NNECO's December 27, 1995, letter. However, the NRC staff continued reviewing NNECO's conclusion that the 14 CIVs did not require Appendix J testing.

The NRC staff has completed its review and agrees with NNEC0's position that these CIVs do not require Appendix J testing. The staff's evaluation supporting this conclusion is enclosed. This closes TAC NO. M89398.
