Dear Mr. Noonan:
On December 3, 1985 you notified me that any further comments that CASE had on the CPRT Program Plan must be received by the NRC "not later than December 23, 1985 in order that they may be considered " before the NRC issues its evaluation of the Plan.
CASE cannot comply with that deadline because we have still not received either the Revision 3 to the program plan or, more importantly, the attribute or inspection checklists upon which the validity and the adaquacy of the program plan ultimately rests.
CASE has been diligently seeking these checklists for months, both from TUGCo and from the NRC staff.
Our efforts have been continuously fruitless.
Frankly, in light of your letter I am concerned that our
" good faith" working relationship with yourself and the Applicant on the Program Plan has been a significant waste of our time and resources.
We have always been led to believe that the attribute checklists would be made available to us prior to our final comments on the plan.
Please be advised that we must have the attribute checklists no later than December 23, 1985, if the NRC expects to get our comments by January 15, 1985.
Further, we will not produce any j
comments at all until we have seen the final Revision.
