MEMORANDUM AND ORDER By letter dated June 7,1985, the Niagara Mohawk Power Corporation

(" Niagara Mohawk") requests that the Comission grant an extension from the November 30, 1985, deadline for environmental qualification of electric equipment at Nine Mile Point Nuclear Station, Unit 1. The request covers one item of equipment for which an extension is sought until the spring 1986 plant outage. The Comission has reviewed in detail the licensee's submittal and the staff's analysis and recomendation as set forth in SECY-85-319. Based on this review the Comission finds that the licensee has demonstrated the exceptional nature of its case such that an extension will be granted.

The Comission most recently addressed the environmental qualifica-tion issue in Generic Letter 85-15, issued August 6, 1985. In that letter the Comission stated that extensions from the November 30 gjl180363851115 C ADOCK 05000220 PDR

dea'dline established in 10 CFR 50.49(g) would be granted "only in rare circumstances." The Comission further stated that extension requests "must clearly identify the exceptional nature of the case, e.g., why, through events entirely beyond its control, the licensee will not be in compliance on November 30; the date when compliance will be achieved; and a justification for continued operation until compliance will be achieved." The Comission also set forth an enforcement policy

.regarding failure to meet the deadline.

Clearly, this licensee.has made a good faith effort to meet the deadline. Only one item (four valve actuators) remains to be qualified and, as to that item, the record shows that the . licensee diligently _

sought to procure qualified equipment but, through events beyond its control, is unable to complete installation. It was only through

-failure of the licensee's supplier to provide the equipment on the scheduled delivery dates that it could not be installed during the last scheduled refueling and maintenance outage in mid-1984. The equipment,-

which is most safely and efficiently installed while the plant is not in

. operation, now is available at the site. The licensee has 'comitted to -

install the equipment during any. outage of sufficient duration, but in no event later than the next scheduled refueling outage in the spring of

-1986. In this regard, the Comission also finds it significant that if 4

the licensee undertakes a special outage to replace the valve actuators, the work would have to be duplicated in the spring 1986 refueling outage i=

because the valves associated with the actuators are going to be replaced at that time.

The Comission therefore grants the request of Niagara Mohawk for an extension on Nine Mile Point Unit 1. The staff has reviewed the

- justification for continued operation and finds that it supports safe operation until the spring 1986 refueling outage. The deadline for equipment qualification is hereby extended until that outage, but no later than March 30, 1986.
