February 19,1997 MOTION OF INTERVENOR. CITIZENS AGAINST NUCLEAR TRASIL FOR AN EXTENSION OF TIME TO RESPOND TO LES'S AND THE NRC STAFF'S APPEAL BRIEFS Citizens Against Nuclear Trash (" CANT") hereby moves for a very brief extension of time (7 days) to respond to the appeals briefs that will be filed by LES and the NRC Staff on or before March 13, 1997.
j Pursuant to the Commission's order of February 13,1997 (which undersigned counsel received on February 18, 1997), the Commission has decided to grant the petitions for review filed by LES and the NRC Staff. The Commission's order set the following briefing schedule:
LES and the Staff will file their briefs on March 13,1997; CANT will file its responsive brief on April 10,1997; and LES and the Staff will then file their reply briefs on April 24,1997.
i CANT requests an extension of 7 days to file its brief, so that the brief would be due on April 17,1997 rather than April 10,1997. (An additional 7 days for LES and the Staff to then file their reply briefs would therefore be in order, changing the date for the reply briefs form April 24,1997 to May 1,1997.)

The extension is necessary because both counsel for CANT will be out of town for ten days during the period set for preparation of their brief (from March 28 to April 7,1997).1

Thus, without an extension counsel for CANT will not have sufficient time to prepare a response

to the briefs filed by LES and the Staff.
The Staff has no objection to this motion. LES alleges that it "cannot agree" to this motion. The very brief extension of seven days requested by CANT will have no effect on the i
Commission's overall schedule for reaching a decision on LES's license application, as major portions of the case are still before the Licensing Board.
Accordingly, CANT respectfully requests that the Commission grant a brief extension so that CANT's responsive brief is due April 17,1997, and LES's and the Staff's reply briefs are due May 1,1997.
