APPLICATION FOR AMENDMENT OF CONSTRUCTION PERMIT NO. CPPR-148 TO EXTEND CONSTRUCTION COMPLETION DATE The Cleveland Electric Illuminating Company, Duquesne Light Company, Ohio Edison Company, Pennsylvania Power Company, and the Toledo Edison Company

("Permittees") are the co-holders of Construction Permit Nos. CPPR-148 and CPPR-149 authorizing construction of the Perry Nuclear Power Plant ("PNPP"),

Units 1 and 2..

Construction Permit Nos. CPPR-148 and CPPR-149 were issued by the NRC on May 3, 1977. Construction Permit No. CPPR-148 currently specifies November 30, 1985 as the latest date for completion of construction of. Unit 1. Construction Permit No. CPPR-149 specifies November 30, 1991 as the latest date for com-pletion of construction of Unit 2. These construction completion dates are extensions of the dates originally specified in the construction permits. The NRC order granting the extension of the construction completion dates for the Perry Nuclear Power Plant, Units 1 and-2 was issued in a letter dated December 29, 1982 from Darrell G. Eisenhut to Murray R. Edelman.

Construction of. Unit 1 is essentially complete. Preoperational testing is also essentially complete and programs are in place to assure that the Perry Nuclear  ;

Power Plant, Unit 1 is ready to load fuel and to achieve subsequent operating l milestones'as they approach.

In order to provide for further time contingencies as explained below, Permittees respectfully request, pursuant to 10CFR50.55(b), that the NRC amend Construction Permit No. CPPR-148 to specify December 31, 1985 as the latest date for completion of construction of Unit 1. Extension of the latest date for-completion of construction of Unit 2 is not raquested at this time, since the: construction permit for Unit 2 does not expire until November 30, 1991.

In our earlier request for an extension of the construction completion dates for PNPP, Units 1 and 2, we referred to " currently unforeseen problems

[which] could cause a delay in completing one or both [of] the Perry Units". 2/ -

Our current request for an extension of time for completion of Unit 1 beyond November 30, 1985 is based on the following previously unforeseen conditions, beyond the control of Permittees, which occurred subsequent to our earlier request:

o The cumulative effect on our project schedule of the numerous changes and additional requirements for plant design and construction imposed as a result of the Three Mile Island accident was significantly greater than estimated in our previous request to extend the construction completion dates for PNPP. For example, implementation of changes in the area of Human Factors had a significantly greater impact on the construction and testing schedules than had been anticipated.

o Many of the other changes and requirements imposed during the course of the NRC's regulatory review took longer to implement than had been expected.

For example, increased time was required to install the additional mod-ifications resulting from the fire hazards analysis review to achieve com-pliance with Appendix R. This, in turn, delayed other critical path activities, including preoperational testing.

e o New requirements were imposed subsequent to our earlier request for an extension. One example is the extensive program required to revalidate the Transamerica Delaval, Inc. ("TDI") Standby Diesel Generators in light of problems associated with TD1 units at other plants.

o Finally, the delay in completion of construction activities had a schedule impact on the preoperational test program for Unit 1. In addition, the preoperational test program itself has taken longer to complete than originally anticipated.

The requested amendment of Construction Permit CPPR-148 to extend the completion date for Unit 1 to December 31, 1985 is, we believe, a reasonable and prudent extension of time which allows for further unforeseen contingencies which might affect completion of the preoperational testing program for Unit 1.

Of course, in the event that an operating license is issued for Unit 1 by November 30, 1985, this request should be considered withdrawn.
