REQUEST FOR TECHNICAL SPECIFICATION AMENDMENT FOR UNION ELECTRIC COMPANY, CALLAWAY PLANT, UNIT 1 (TAC NO. M98445)

Dear Mr. Randolph:

By letter dated April 24, 1997, Union Electric Company (UEC) requested a change to the Callaway Technical Specifications (TS) to revise the title i

" Senior Vice President, Nuclear" to "Vice President and Chief Nuclear Officer." Attachment C to the letter stated "Specifically, the title of Senior Vice President, Nuclear is replaced by the title, Vice President and Chief Nuclear Officer. Other than title designation, the position remains unchanged in the Union Electric management structure.

The same staff that reported to the Senior Vice President, Nuclear will report to the Vice President and Chief Nuclear Officer.

There will be no reduction in the level of management oversight in the operation of Callaway Plant."

It is my understanding that the requested change, characterized in your letter as a title change, is in fact a reorganization that took effect May 1, 1997, in which the Vice President, Nuclear Operations position was eliminated and the staff currently reporting to the Vice President, Nuclear Operations now reports directly to the Vice President and Chief Nuclear Officer.

Because we consider the change to be a reorganization at the senior management level and not simply a title change, we request that you provide a supplement to the April 24, 1997, request for amendment that provides (1) information on the UEC management structure prior to and after the reorganization, and (2) justification that sufficient management oversight remains subsequent to the elimination of a single level of senior management oversight.

Revision of the significant hazards evaluation is also warranted to include the evaluation of the reorganization as discussed above.

It is also my understanding that UEC concluded the reorganization did not reduce the commitments in the Quality Assurante Program. 'We will review this determination when your 10 CFR 50.71(e) submittal is received.

Mr. Garry L. Randolph May 2,1997 Further, during a telephone conference on April 22, 1997, your staff indicated that UEC planned to submit a letter to the NRC (versus a TS amendment request) to inform the NRC of the title change in the TS.

This plan was not consistent with the requirements of 10 CFR 50.59 as was pointed out to you.

In response, you submitted the subject technical specification amendment.
