Docket No. 50-400 6 /,

Administrative Judges Kelley, Bright and Carpenter:

Please find enclosed copies of the following testimony which Applicants will present at the hearing to resume November 12, 1985 on CCNC Contention WB-3:

1. Applicants' Testimony of Dr. Robert L. Dupont, Jr. on the Effects of Employee Drug Use (CCNC Contention WB-3);

2. Applicants' Testimony of Harold R. Banks and Roland M. . Parsons on the Construction Quality Assurance Pro-gram (CCNC Contention WB-3);

3 .- Applicants' Testimony of Harold R. Banks, Roland M.

Parsons, George L. Forehand and Thomas W. Brombach on 2 valuation and Reinspection of Work Performed by Employees Implicated in Possible Drug Activity (CCNC Contention WB-3); and,

4. Applicants' Testimony of Eugene F. Trainor on the Ca-

- pabilities and Performance of Applicants' Construc-tion Quality Assurance Program-(CCNC Contention WB-3).

In the absence q6 any schedule conflicts, Applicants would have presented Dr. DuPont as their first witness, because his testimony logically precedes the others in content. Unfortu-nately, Dr. DuPont has long been scheduled to make an important presentation in Washington, D.C..at 9:00 a.m., Tuesday,

- ' November 12, at a conference sponsored by the Pacific Insti-

'tute, and in which the First Lady is likely to participate.

,Dr.lDuPont will leave for Raleigh after his presentation, and Lis scheduled to arrive at the airport at 1:13 p.m. He will ~

proceed directly to the hearing, and Applicants propose to in-terrupt the examination of their other witnesses to present Dr.-

.DuPont's testimony. E'.nce he must also be in New York City to deliver a long-scheduled speech on November 13, Applicants ask the cooperation of the Board and parties in completing the ex-amination of Dr. DuPont on the 12th. He is available for exam-ination as late into Tuesday evening as is required. Given the

. brevity.of his testimony, it is our hope that this will be suf-ficient time for whatever examination would have occurred under normal circumstances. (As the Board is aware, counsel for CCNC is not available for consultation on these matters.)

Because'tha subject matter of the testimony is so in-tertwined, Applicants plan to present at the outset of the hearing the five witnesses sponsoring.the remainder of the testimony (items'2, 3 and 4 above) as a single panel, to offer all three pieces of testimony.at once, and to make the witness-es available for crces-examination on all three pieces of testimony at the same time. This will avoid cumbersome de-ferrals of questiond:'and fragmentation of the record.

-October 25, 1985 Page-3 Applicants will also offer as direct evidence the follow-ing exhibits, copies of which are enclosed:

Report to Nuclear Regulatory Commission Staff of Evaluation and Reinspection of Work Performed by Employees at the Shearon Harris Nuclear Power Plant Project Who Have Been Implicated in Possible Drug Ac-tivity (Revised 10/15/85); and, Procedure CQA-7, " Evaluation of Program Effective-ness," Carolina Power & Light Company, Harris Nuclear Plant Project, Quality Assurance and Construction Sections.

These exhibits are not discussed in Dr. DuPont's testimony, and will be sponsored by the CP&L witnesses. The first exhibit.

identified above updates and expands upon, and therefore re-places, the information transmitted to the Board and parties by letter'of September 19, 1985, from S. R. Zimmerman (CP&L) to Harold R. Denton (NRC).

Finally, Applicants call attention to the fact, reflected in the pre-filed testimony _ enclosed, that currently unavailable direct evidence will also be offered on two subjects: (1) the results of eddy current retesting of a sample of the Harris Plant steam generator tubes (the retesting is not yet complet-ed); and (2) the results of evaluations now underway of work performed by three inspectors. implicated in possible drug ac-tivity.

Respectfully submitted, Thomas A. Baxter Counsel for Applicants TAB:jah
