Dear Administrative Judges:
On September 18, 1985, the Licensing Board issued Memorandum (Water Recirculation Problems Caused by Paint).
On October 9, 1985, the NRC Staff responded with a " Motion to Reconsider and Response to Board Memorandum of September 18, 1985."
Applicants have reviewed the Staff's response and herein support the Staff's Motion.
The Staff's response correctly characterizes the Memorandum as requiring the following:
(1) an explanation from the Staff as to why Comanche Peak was placed in a "special category" by SSER No. 9, which granted "an exemption from ordinary paint quality assurance requirements" (Memorandum, at 4);
(2) that those members of the Staff involved with USI A-43 be informed of the SSER because the "exemplici" for Comanche Peak P "ama, o

The Staff's response makes the following points with respect to the Board's three requests.

The Board's characterization of Comanche Peak as being placed in a "special category" is incorrect.

An affidavit explains j
that no exemption is legally required to allow justification by analysis of non-qualified coatings.
Moreover, the affidavit explains, as a factual matter, that many plants safely utilize non-qualified coatings.
The Staff threrefore moves for Board reconsideration of the Memorandum on this item.

The Board's direction that SSER No. 9 should be brought to the attention of those members of the Staff involved with j
USI A-43 is unnecessary.

An affidavit explains that Staf f personnel responsible for resolution of USI A-43 actually participated in the Staff evaluations reported in SSER No. 9.
