Dear Mr. Hoyle:

We are in receipt of an ORDER TO SHOW CAUSE regarding the dispo-sition of unirradiated highly enriched nuclear reactor f uel (HEU) held under Faci l ity Operating License R-73 (Docket No. 50-139).

Upon receipt of this order, we immediately took the necessary steps to dispose of this unirradiated HEU f uel by notif ying the Rich l and Operations Of fice of the Department of Energy that we wished them to resume physical custody of this fuel which is owned by the Department of Energy.

l M s. Rhoda Roesch of the Richland Operations ,0f f ice of the l Department of Energy ( R OO-D O E) has Informed us that the time 1 required to f u l l y identi f y, categorize, and prepare this fuel for

shipment and to arrange transportation in accordance with a l I i relevant regulations will require more than the allowed 120 days.

! diatel y upon receipt of the order, and because it is not possib l e

' f or R00-00E to imp l ement the shipping and receipt of the fuel during the required 120 days, we hereby request that our author-l Ity to possess unirradiated HEU fuel be continued until such time as ROO-DOE is ab l e to assume possess ion.
