Tobyhanna Army Depot Tobyhanna, Pennsylvania 18466-5097 As a result of the telephone inquiry conducted on September 26, 1985, and in

! accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the follow-ing violation was identified:

i A. 10 CFR 30.3 requires that no person possess or use byproduct material except as authorized by a specific or general license issued pursuant to Title 10, Chapter 1, code of Federal Regulations.

Contrary to the above, on September 26, 1985, Tobyhanna Army Depot pos-sessed equipment containing less than 9.5 millicuries of krypton-85, a byproduct material, without a valid ifcense.

This is a Severity Level IV violation. (Supplement VI)

Pursuant to the provisions of 10 CFR 2.201, Tobyhanna Army Depot is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results i achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is

shown, consideration will be given to extending this response time.
